If not, the entire edifice of constitutional democracy may eventually collapse under the overwhelming weight of political intolerance and undemocratic radicalism.

What exactly is a Marxist conception of law and can the learned Mr. Zimmerman give us an example from Brazilian jurisprudence?

Karl Marx did not study law nor - as far as I am aware - do his social theories have anything at all to say about law. So based on what, exactly, can Mr. Zimmerman classify a law as "Marxist"? Is simply a law that Mr. Zimmerman does not like? Or is he applying some sort of logical or objective criterion here?

Populism, collectivism and the rejection of economic freedom are not concepts necessary or specific to Marxism. Fascism was quite populist, collectivist and violated all sorts of economic freedoms. The Brazilian military dictatorship was hardly a paragon of free enterprise, either.

It seems to me that while the Brazilian elite may (or may not) have the problems Mr. Zimmerman describes, his classification of this sort of view of the world as "Marxist" stems from nothing more than his addiction to the term as a catch-all ad hominem insult for those people whose veiws he disagrees with.

And while Dr. Sader may be exagerating in his description of Getulio Vargas as "democtratic", that's certainly no call to slap Dr.Sader on the black list (which seems to be Mr. Zimmerman's goal). After all, I can quote President Roosevelt and Prime Minister Churchill saying the same thing, too. And U.S. political leaders were quite open in their classification of Brazil's military leaders of the 1960s and '70s as "democratic" when that gang of puffed-up martinents quite clearly killed and tortured as many people as Vargas. But then again, I suppose Mssrs. Churchill, Roosevelt, Kissinger and Nixon are also crypto-communists in Mr. Zimmerman's view of the world, too.

Want to know what one of the REAL problems of Brazilian politics currently is today? People like Dr. Sader and Mr. Zimmerman who seem intent on refighting the cold war using methods of the Inquisition. While I certainly wouldn't want to se Dr. Sader in power, Mr. Zimmerman's glib ad hominem attacks and jeremiads against a supposedly evil tradition of "marxist law" (which simply doesn't exist in Brazil) certainly bode ill for freedom of speach and democracy were his ilk ever to gain the presidency.

"Normal democratic reality" for both Sader and Zimmerman apparently means "absolute belief in my particular set of philosophical coordinates". And this highlights the REAL problem of Brazilian democracy, amply discussed by Sergio Buarque de Holanda some 75 years ago in "Raizes do Brasil": we are a country which fundamentally believes in CONSENSUS and not the measured play of ideas. We are only truly happy when ONE OFFICIAL ideology is presented for our consumption and when all around us declare it to be the TRUTH.

The only difference between Dr. Sader and Mr. Zimmerman is the "truth" they would shove down our collective throats. But the bonfires that both gentlemen would maintain for heretics burn equally bright, equally hot.

He joined the University of Bonn in the course of Law (one year), the following year he moved to the University of Berlin where he studied more 4 years of Philosophy.

Marx wrote about Right !
His first book was about Right !

He wrote the book:
Critique of Hegel's Philosophy of Right, Karl Marx -1843.


Marx did not "social theories", that is absurd ... Marx did critical of economic policy and personal attacks against philosophers.
