David Goldberg and son SeanI honestly don't know where to begin with the Goldman case, because there have been so many twists and turns this Friday that the case has been entirely turned upside down. My head is literally spinning with all of the things that happened today, so I'll try to explain them as coherently as possible.

The Brazilian family was granted a stay by a judge known for going against the other judges and also known for close political ties with the family. The decision meant that the case could be drawn out until February or longer, even though it's been going on for five excruciating years.

Secretary of State Clinton commented on the TRF-2's unanimous decision to send Sean home and how she was happy that the case was going in the right direction. You can imagine how she probably felt when she found out about Marco Aurélio's little stunt, especially given the fact that the request - for Sean to be heard in court - was already denied months ago by the Supreme Court.

So suddenly, the wheels started spinning very fast. The international media is all over the story, and suddenly Brazil's embarrassing judicial system is in the spotlight once again. Since Congressman Chris Smith is with David in Brazil, word got back to Congress that there was more trouble. So Senator Lautenberg from New Jersey halted a bill that would give trade preferences to Brazil in protest.

Then this evening, David's lawyers and the AGU, the attorney general's office that represents the Brazilian government, both filed separate injunctions (to be exact, writ of mandamus) against Marco Aurélio's decision, directly challenging it.

Meanwhile, Marco Aurélio was kicked off the case and even though the STF is now on summer break, they will hold an emergency session in the next few days. It's unclear whether a definitive decision will come out of it, or if David will in fact have to wait until February.

Oh, but there's more. In reiterating its support for David, the AGU stressed that Brazil is in danger of threatening reciprocity agreements if it fails to live up to its commitment to the Hague Convention, and even said that Brazil may be tried in the Inter-American Court of Human Rights about child abduction.

It also underlined the threat of international repercussions, which the family's lawyer, Sergio Tostes, also claimed was a serious problem with the case yet again. The AGU says that David must be given custody of Sean "as a matter of urgency."

No wait - there's more!

Also this Friday, Tostes had the unbelievable chutzpah to send David a letter inviting him to have Christmas dinner at the abductor's home - that is, at Sean's grandmother's house. It's their way of trying to make it seem like they have made Sean available to David all along and that they're friendly with David, even though they refused to let him visit for five years, returned his packages and letters and gifts, refused to let him speak to Sean by phone or e-mail, and the little fact that David received death threats when he refused to give up the legal battle.

David only managed to see Sean in early 2009 under court order, accompanied by court marshals, a US congressman, and several people the Brazilian family ordered to be in the same room at all times with David. The last time he saw Sean was in June, though the family refused to let Sean leave the condo complex and subjected him to obvious psychological torture and parental alienation during the visit.

I swear, there's more.

During a press conference today, Tostes also said that the abducting family is ready to negotiate. This is the absolute last thing I expected to happen, and is due to two things: 1) they know they are going to lose the legal battle - rumors are swirling that the higher courts are fully ready to give custody to David, and mostly 2) it seems to me that political pressure is coming from very high up in the Brazilian and American governments like never before, since this is turning into an international affairs crisis yet again.

However, this isn't exactly up for negotiation - they committed international child abduction, among many other things, and the law is crystal clear that Sean's custody must be tried in New Jersey. So I'm not sure how they exactly expect to negotiate, but that remains to be seen.

There's more!

Even though the Brazilian family is making a last ditch effort at being diplomatic, they also mentioned during the same press conference that they will go after David with "evidence" and "prove that he's an unfit father." Epic fail.

In other news, in a great article from Seth Kugel, the tide of public opinion in Brazil finally seems to be moving in the right direction, as the lies fade away and people realize what is actually going on. It made me extremely happy.

Earlier this week I was more pessimistic than ever, but things have taken an unbelievable turn for the better and this house of cards may fall just yet.

The story is so scewed. The mom was married when she went to Brasil. She divorced David there. Married women can travel with their own children, so how was the child "abducted"?

The case is a pack of lies made up by Father's Rights people who want to hunt down and kidnap the single gamete that gestated and grew in a woman's belly with HER nurturing.


Shame on all of you for tormenting this boy and trying to take him away from his SISTER and family because you want the FATHER to have more rights than the mother or child. The child should have a say. It's his life.

The recent filings by David and on his behalf are a Hail Mary pass and a publicity play. If this is what you're hanging your hopes on calling it "all looking up", you're deluded. The political influence he's brought with him is what has gotten him the opportunity to make this pass, but it's an extremely serious claim being made against a supreme court judge, and it will not be granted simply because US politicians make noise. Judges can be in the minority opinion without being corrupt, and to approve this filing would basically stamp a supreme court judge as corrupt only on the basis that he gave an appeal a chance to be heard. I don't see any individual judge supporting that claim, regardless of political influence. At best, the full court would have to consider it, and that will not happen until after the break. In their interviews the US congressman and David conveniently would not put odds on their chances of success with this motion, but I will - between slim and none. It's basically a publicity piece for them and they know it. The Brazilian judiciary knows it, and that's why Tostes is doing his own publicity piece. The rest of us shouldn't buy into the hype from either side.

I was shocked to read the responses on this post regarding the Goldman case. It is unthinkable that there are people in this world that would believe that with the passing of a mother the father should not have custody. It would be one thing if the mom was still alive. In that case there should still be a custody agreement. But the fact of the matter is that some people are not mentally stable. Some people do extraordinary things that are simply put, illegal and unmoral.

Justice - Your comments show that you are off your rocker and need mental help.

Whoever the person is that is unwilling to ad their name to their comments is obviously just a mean, sad person. looking to hurt people because they want to discredit the facts.

Chloe - Your on another planet ignoring what is going on, and acting like your intelligent. It is obvious you support the Brazil family which makes you a supporter of child abduction.

Humanity is a very fragile thing. It is extremely sad to see a country being represented in this way, and even sadder that the officials of that country have not taken a stand to show the world that this kind of behavior will not be tolerated. I understand that some people have power, money, and influence, but in these cases it is up to the general population to stand against this corruption and show who has the real power, the people.

The offer to allow the father to Christmas dinner is insulting, The entire family should be horse whipped for their actions, and thrown in jail for a very long time.

I am completely with you, tdog. It's hard to believe that you have to defend the right of a loving father to raise his own child who was stolen from him. And yes it is stolen- if one parent takes the child away to another country without the consent or knowledge of the other parent. It simply isnt legal. If you disagree then go ahead- bring a lawsuit against the UN and try to get them to overturn the Hague convention. Good luck with that.

tdog - I'm doing the opposite of what you've accused. I am intelligent and I'm not ignoring anything. I'm looking at the facts, history and the laws. I'll count the emotional appeals and internet posts from people who clearly only want to hear that everything's gonna be alright and soon, for what they're worth in a courtroom, or in the chambers of a Supreme Court Judge - nothing. Emotion has very little to do with the laws. You don't like the fact that there have been appeals and those appeals have been protracted but legal, tough. You want to be optimistic about the results of these two appeals that have been filed by David and the AGU, that's your business. But for people who have the slightest clue about the law it's not "looking up." The facts don't change because you don't like them or don't want to believe them. They remain the facts. This is a very rare filing they've used that requires a large amount of proof. But there's no proof, just emotions and speculation, if you've read what the AGU filed. Actually the AGU filed because their request could be made public and add to the publicity while David's legally could not. This case is not going to be decided in the media but in courtrooms where you need to bring more than emotion and opinion. Right now this latest play has very little chance to win anything in the courtroom, but clearly it's real purpose is on winning in the media. There's a reason they've been so cautious not to answer questions about this type of motion. It's also this media play that's prompted the other side's latest media play which they also know will do nothing to resolve this case. Until both sides get back to fighting in the courtrooms with motions designed to win in a courtroom, this case is not going to move forward.

at all of the ignorant comments by the fans of the kidnappers here. This case has been decided by the Brazilian courts twice already. It really is rather simple. This child was abducted illegally by his mother who had plans to keep him in Brazil with her new lover/future husband. She did not have permission from the father to do this, nor did she have a court order allowing the move. This is a crime in any civilized nation, including Brazil and the United States. It is also considered a child abduction according to the Hague Treaty which Brazil signed.

This is not an issue of whether the boy wants to leave his sister or his kidnappers. There have been hundreds of cases over the years of kidnapping victims becoming friendly with their captors. Just look at what happened with Jaycee Dugard in California. Almost anyone can be brainwashed, especially an adolescent. The Hague treaty does not give the boy the right to decide where he wants to live. If his mother were alive, it would not be the case, but she is not alive, and neither the grandmother or the step father have any legal right to keep this child. This has been decided by the courts of Brazil, yet the family and this Aurelio refuse to comply.

Yes, the U.S. Senate is going to push it's weight around, and so is the U.N. I know many Brazilians have much national pride and dream of a Brazil which is powerful enough to have it's way in all circumstances, but at present, this is not the case. The Lula administration, despite all of it's horn blowing and attempts at bullying the U.S., have made even bigger efforts at gaining access to the U.S. marketplace, and it will cost billions over the next few years if this doesn't happen. Just look at what becoming a favored trading party with the U.S. has done for the Chinese. Brazil does not want to lose this opportunity.

Brazil has recently gained a seat on the U.N. security council, but this does not make them a heavyweight on the council. They can easily lose any international credibility they have recently gained by refusing to comply with U.N. treaties, such as the Hague convention on child rights and welfare.

So, my brother Brazilians, it's time to step up to the plate, and assume the responsibility we accept when we want to play with the big boys. as a nation, do we let a self appointed, self acclaimed bully like Silva cause our country to take a step backward just to serve his ego, or do we accept the responsibility that comes with our ambitions of playing on the international stage?

In answer to those who claim the filing of the writs today is just a show for the media. The fact is, these writs are a legal procedure intended to force the case into the higher court and to resolve the case based on it's legal merit, rather on endless filings of delays and appeals. Aurelio should never have been able to work this case in the first place due to his affiliation with the family of the kidnappers. In any civilized nation other than Brazil, this would never have been allowed.

Ha! This same thing is happening in the very civilized nation of the United States of America. Your own courts have cases pending before the US Supreme Court dating back from May 2006! One example is the Abbott case. Look it up, before you accuse another country of being wrong for doing the same thing this country is doing! You point fingers and mock the Brazil judiciary for allowing 3rd party motions on this case, but just a few weeks ago there was a 3rd party filing accepted by your own supreme court on the Abbott Hague case. Your own Supreme Court Judges are not even going to look at this case until 2010. It's not even the only case Hague case like this dragging out for years in US Courts, but where's the outrage over that? There is none, because you're only interested in helping Americans and pushing around other countries. When it's a foreign parent in American courts, you hear crickets while they wait for years for a hearing. Your own Supreme Court Judges have agreed to hear the appeal on the Hague case, so how the hell do you think you can tell Brazil's Supreme Court that they're wrong to hear an appeal on a Hague Case?!

This is the attitude that keeps Brazilians in the dark. Having spent three years in the U.S., I found almost all Americans to be very friendly and supportive towards Brazilians. I cannot understand why so many Brazilians hate their neighbors to the north unless it's just envy.

was concerning the judge who is a close ally of the family which has possession of the child. Show me where this is happening in the U.S. or any other country. If the judge did not recuse himself, it would only be a matter of procedure for him to be removed by filing a request in the U.S. court. This is not happening in the Abbot case or any other case you can find.

No I cannot believe some of the insanity here. The case is simple, the child is not property but instead has a mother and father. Laws are clear, when one dies, barring serious and affirmed abuse, not alledged, the child goes to the living parent. Instead a non relative kept the child illegally. That is kidnapping. Saying the child is fine and with grandparents etc. is bogus bulls. The child is being manipulated and brainwashed and I guarantee you will be home before Christmas, that is why the family is finally trying to negotiate. I totally support David to steer clear of the kidnappers and just take his boy far away from the country I will never ever step foot in. It is such ashame because I have a Brazilian Aupair that has been in our family for years, she is ashamed and embarrassed of the land she called home

Let us all remember this is a 9 year old boy who has been kept from his father for more than 5 years.

Goldman has argued that as the sole surviving parent, he should at last be granted custody. This is not only customary world wide, but law as mandated by the Hague convention.

Three court-appointed Brazilian psychologists tasked with determining the boy's emotional and psychological well-being had unanimously concluded that he is being hurt emotionally "by the continuance of this abduction." The word "abduction" is the quote from the Brazilian psychologists, after interviewing and examining Shawn.

Sean was previously put in front of a video camera as adults asked questions. The boy made remarks in that video that members of his mother's family suggest indicate he should stay in Brazil. If the court allows a child's drawings or such a videotape to be used as evidence in a courtroom, Smith said, "every kidnapper everywhere in the world -- every child abductor in the world" would have the children make such things.

Goldman also addressed the videotape: "What is he going to say? 'No, I hate it here,' knowing he'll go back up under their roof? What do you expect? He is an innocent, helpless, vulnerable, defenseless child that needs to be freed from this circumstance."

All the "surveillance" present at the time of the February visit -- including a psychologist that the family had "almost right next to David and Sean the whole time" -- made it "an oppressive situation."

Remember, this is a 9 year old boy who this family of kidnappers would use as a pawn to get their way in the courts, and every one of you, if your own child were taken from you illegally and used in such a manner would be outraged in the same way David Goldman is. This is and will be a terrible show to the world of the shame of corruption in Brazil, if a family which has no legal right even by Brazilian laws is able to detain this boy because of their political connection to a judge.

Sean Goldman has been subject to a common set of behaviors in high conflict separations/divorces, where a parent, and /or others, is more focused on their own needs than that of the child.

Sean, by all accounts is a normal child with the need to be love and be loved by both his parents. The unfortunate circumstance of his mother no longer being alive makes it all the more urgent that he be reunited with his only remaining parent, a courageous, articulate, tenacious and most of all, loving father.

Many other parent who are unable to sustain the onslaught of attacks from behind their children give up and live far too early. Both they, and more importantly their children live lives of desperate solitude.

We applaud David for his strength of will and love of his Sean. This is a very difficult (and expensive) road he has been traveling.

For those of you who remain skeptical about what happens to children who have been abused in this way, you can read their stories both as young children and as grown adults here

I am a Brazilian and father of two kids: one born in Brazil and the other born in the US.

About Goldman's case: If the mother was alive then I would defend the fact that the kid should remain with his mother but since she is gone then the kid should go to Mr. Goldman. It is his God given right. Yes, there many complications because of laws of two different countries but the fact is that Mr. Goldman is the father. Period.

Don't hate Brazil just because of that. Remember the US also break international agreements and that is a fact and many times go unpunished.

Also it is important to remember that the kid is a native Brazilian citizen and we must preserve his right of having contact with his sister and Brazilian grandparents. Do you think that Mr. Goldman will remember that? Hope so.

Another fact, the kid is not living a miserable life in Brazil. His Brazilian family is relatively wealthy. So, he would have a pretty good life in Brazil in terms of quality of life, education, good medical care, etc.

The really bad thing is that the whole story became political and people from both countries are simply insulting one another. Sad!

Let's hope that Mr. Goldman can have his kid and he can go back to his obscure life that he had before this crisis.

However, he needs to remember that his kid is also Brazilian, has the Brazilian blood, has family in Brazil, etc.

I'm astounded at how many people cheer for the crooked Brazilian lawyer and his judge friend. If this Silva had even the slightest reason to run you over and take everything you have, he would do it, yet you love him as if he is some sort of Robin Hood. AMAZING ! ! ! The folly that surrounds this case is one of the most outrageous exhibitions of misplaced sentiment I have ever witnessed. It is a case of a boy being deceptively taken from his natural father, and being held as an international chess piece, and all you can think of is Brazil vs the U.S. What has happened to the human spirit?

God must be outraged at this spectacle.

Neither did Sean or David Goldman commit any of those atrocities you mention. Are you thinking you're on a different page, and commenting on this one? This is not a case of Brazil vs the U.S. It's a case of a young child being stolen from his natural father. I understand you may not have the intellectual capacity to seperate the two, but one day, when something bad happens to a close relative of yours, I'm certain you will just blame it on the U.S. The evil gringos did it.

For the folks who bring up the Abbott case in the USA, here are some facts that you should know before you accuse the USA of being hypocrites. First of all the Abbott case is not about custody but about a clause in the custody agreement that prohibited one parent from moving the child to another country. The parents were already divorced with the mother having primary custody and the father visitation rights. The mother violiated the order not to move to another country without permission from the father, but the father has not and never was denied his visitation. The mother is therefore arguing that it isn't a kidnapping and it doesn't apply, the father says otherwise. She didn't leave Chile (where they were divorced but to my knowledge neither party is a citizen of -- she is American, he is British) to keep this child from his father. That is why she argues it isn't a violiation and the US courts are going to clear that matter up.

Sean Goldman was moved from the US to Brazil to keep him from his father and to make sure his mother got sole custody. That is kidnapping 101.

The little boy's dead mother should have sued for custody in NJ courts and then fought for the LEGAL right to take her son to Brazil if that is where she wanted him to live. She chose to be a kidnapper, her wishes stopped mattering when she prevented her son from having a relationship with his father.

I do laugh that now, 5 years later, her family is willing to negotiate. Maybe they should have tried that 5 years ago. Most divorcing parents do.

Finally, the ruling has come down and Goldman has won. Not the USA, not Brazil, but Sean Goldman. To have one's son back must indeed be a wonderful thing. I see all these nasty remarks made against both countries and I wonder: What would you have done if it was your son? Would you let someone else raise your son? Would you allow someone else tell you to give up you god given parental rights? Would you stand for that? I think not. So now, finally, let us put this to rest, the hatefulness. Even we don't always get our way. We only get Sean, but not the other 62 American children who were abducted to your country. When they finally return home, only then will this truley be over.

I have Brazilian friends. I have visited Brazil and it is a beautiful country. You have serious problems, but so do we. But to wish death on the Goldmans, both David and Sean, because they won the court ruling is depraved and just plain sad. Now… back to the topic:

In a way, I am glad this entire charade about David Goldman and all his synagogue associates is finally over. As a Brasilian, I accept the Supreme Court verdict, that’s fine by me. Deep inside I do feel that a child does belong with his/her biological parents, when and if, those parents are fit to the task of parenting.

I have some serious reservations about Mr. David Goldman’s real motives, considering that he took $150k dollars from his in-laws. Something about this David character is unsettling to me.

I truly hope that Sean finds happiness since this boy has endured enough tragedies in his short life. It is going to be tough for him, for the next few months. Changing of cultures, new language, being accepted in school as a foreign boy with an accent. Instead of seeing the Sugar Loaf from his window, he will be looking at some old chimney from an old closed plant; instead of warm ocean breezes, he will be walking on slippery ice; instead of warm relation with his loved ones, he will be facing David and his folks; instead of attending familiar Catholic churches, he will be converted and forced to accept some Synagogue services. There is no doubt… This child will be facing a steep uphill battle. Very hard indeed!

As soon as this boy grow up he will starting making a lot of trouble for his father.
A boy brought up in Brazil will carry all the curse of a Brazilian, such as drug adicted and he is already carrying them with him. he'll end up killing his father and white blue eyed relatives.

International law has been applied and for all future cases it was the right thing to do. It should not have taken so long. We can hope that it is a lesson for all countries to enforce the law quickly and correctly. The law is there to protect children and is too important to be enforced by threats of trade agreements being halted.

We can all be happy that the people who pour vitriol on either side of this media frenzy are not responsible for the legal decisions nor the care of the boy.

This boy may be lucky, he has two 'families' who seem to care enough for him to spend hundreds of thousands of dollars to have him live with them.

If the Brazilian press is to be believed; the father is unemployed and until now has not had the means to provide the boy anything near the lifestyle he had in Brazil. That he has a debilitating condition (Guillain-Barré) is irrelevent as he will probably not suffer the effects of it until after the boy is 18.

Personally I think it smells just a bit that he accepted 150k from the boys grandparents. Even if we accept that he did so to pay legal fees, it still has the appearance that he 'sold' custody and then reneged on the deal.
