Sean and David Goldman leave BrazilThe Lins e Silva and Bianchi families' lawyers announced they will continue to dispute custody of nine-year-old Sean Goldman in Brazilian courts. The problem is that under the terms of the Hague Convention on the Civil Aspects of International Child Abduction, Brazilian courts should not decide custody in this case.

Sean, the son of Bruna Bianchi and an American, David Goldman, was born in the United States in 2000. He was brought to Brazil in June 2004 by his mother for a vacation. But soon after arriving, Bruna called David and told him she was staying in Brazil and the boy was staying with her.

In July, Bruna obtained provisional custody of the boy in a Brazilian court (2° Vara da Família). In September 2004, David Goldman filed a claim in a US court alleging his son had been abducted. In November 2004 Goldman went to court again and demanded the boy be returned to the US under the terms of the Hague Convention.

On three different occasions over the next two years a Brazilian family court (2° Vara da Família) ruled that as the boy was "adapted and happy" he could remain in Brazil with his mother. In July 2006, in a Brazilian court (2° Vara da Família), Bruna got a divorce from David and was awarded custody of Sean. In 2007 she remarried and, in 2008, died in childbirth.

Under the terms of the 1980 Hague Convention, the signatory nations, including Brazil and the United States, agreed that in cases in which a parent removes a child from one country, takes the child to another country and keeps the child there without consent of the other parent, the child should be immediately returned to the country he was taken from where the question of custody is to be decided. But, before custody there is the question of return.

The Hague Convention mentions the possibility of denying return when a child is "adapted and happy in an environment," but this is a context not intended in the case of a recently abducted four-year-old like Sean in 2004 (even though he was quickly enrolled in school less than a month after arriving and was indeed living comfortably in an upper class home in Rio de Janeiro).

Sean's Brazilian family and their lawyers, along with the advantage they had of easy transit in Rio family courts, clearly and consciously attempted to exploit loopholes in the Hague Convention over a long period of time - starting in 2004. And culminating in a last ditch attempt five years later to exploit another loophole in the convention and allow the boy, now nine years old, to express his opinion in court.

Letting children express their preferences in international child abduction cases is permitted in the Hague Convention. A Supreme Court associate justice actually accepted the idea of Sean testifying by slapping a stay order on a ruling by a regional federal court (TRF-2) that the boy be turned over to his father.

However, in dramatic fashion, the associate justice's stay order was overturned by the emergency duty Supreme Court judge on Wednesday, December 23, and Sean was handed over to his father on December 24. They immediately left for the US.

Meanwhile, back in Rio, according to the lawyers of the Bianchi and Lins e Silva families, the Brazilian Supreme Court may yet decide to hear testimony from Sean Goldman and as a result they will reverse the TRF-2 ruling. That is a very remote possibility. What all the parties have to do now is sit down and hammer out visiting rights.

It's over for the Brazilian granny. She acted so selfishly. The boy's father has treated her with kindness, despite her maneuvers and complaints and parading the boy in front of cameras during the handover of the boy.

The boy is with his father in the US and that's where he will stay. Case closed. And please, no more interviews with the Brazilian relatives. It's embarrassing to hear how delusional and spiteful they are

Can you imagine this happening to your child? This grandmother manipulated her daughter into all this for the grand mother's sick mental illness. The Brazlian government is looking like a third world corrupt government. The grandmother and lawyer son-in-law are corrupt and belong in prison, and his license to practice law revoked.
David is the father. That is it. He can move to China with his son if he desires. The grandmother has no say.

Uh, didn't you read in the article that Sean's dad first approached the US courts in September 2004? He was actually awarded full custody at that point. Marta, all kids adapt to new lives; parents move, parents separate - the world goes on, children get use to things. The greatest thing about children is their resiliency and ability to adapt easily to new challenging surroundings, cultures and people. Families move around the world daily, however usually LEGALLY and with abducting children, unlike this horrible family.

As for you claims about Rio, well, to put it bluntly Rio is an open sewer full of Brazils worst characters not to mention how violent it is. getting driven to school in an armored plated car, hoping not to be kidnapped is no way to raise a child. And although his private school may give him a decent education (that is up for debate)it's the lessons at home that build character. This family has showed everyone, Brazilians and Americans, how immoral, selfish and corrupt they are. Is that really the way to raise a child?

It is the boy's father's right to be repaid for legal and other expenses incurred while attempting to retrieve his kidnapped son. This is clearly stated in the Hague Convention. And why shouldn't he get some of the $500,000 he spent because evil Brazilians stole his child?

And secondly, he sold nothing to CNN. You can't even get your facts straight.

I can call Brazil a third world country. I live here. It may not be third-world much longer, but it certainly is today.

The FACTS are; David Goldman was the father's name and he is a human being that should be admired for his strength and moral character....He has always put his son first....he treats his son's maternal side of the family with respect.....did they? NO, it was all about the money for them because they didnt want to look like idiots and hand over their prize....They are people that should be ashamed for themselves for what they did to Sean and what they took away from their former son in law.....a peaceful life for a father and a son....

I did get my facts straight. I said he sold nothing to CNN, and he sold nothing to CNN. You need to wrap your third-world mind around the fact that there is more than one network in the U.S. and that people are capable of telling the difference. Unlike networks here in Brazil, they're not all the same--which is to say 24 hour a day novelas featuring bad actors and, lately, monkeys posing as actors. If I had said he sold something to Globo and it was, in reality, Bandeirantes you would be pointing that out.

You can't even get the family name right, idiot. It is Goldman, not Goldstein.

As for helping take Brasil out of the third world I would venture to say that I have done more in that regard than most Brasilians. But to explain how would be to explain what I'm doing here, and I don't at the moment feel accountable to a bunch of paranoid Brasilians who spout errors and then criticize those who take a few minutes to get their facts straight.

My kudos to the author of this article. It is consistent with all reliable sources on the facts of this case. However, I am compelled to address Andrade / defender of Martha. This is well documented, and well documented in Brazil. Second, Martha indicatd that David is looking for money only? Seriously? The Brazilian family kept this case in the courts and yes, David is looking for restitution as is permitted in the Hague. Both of you have a love of Brazil that skews your judgement to a great degree.

Mr. Goldman has been trying to retrieve his son since the day he found out Bruna had LIED about her intentions of returning to the U.S. She abducted the child from his home country of which he was a citizen, and was not a citizen of Brazil at the time. He of course was eligible for citizenship, but was only a citizen of the U.S. at the time of the abduction. This is the clear reason that according to the Hague treaty, (of which Brazil is signatory) he should have immediately been returned to the U.S., and the custody fight should have been undertaken there.

Also, the chartered flight was already paid for by NBC, and was there for the purpose of returning their news crew to the U.S. in time for Christmas. They invited the Goldmans to fly back with the news crew as a courtesy, which cost them nothing extra, wishing to help the Goldmans avoid the type of media circus the grandmother and Lins e Silva seemed to enjoy so much.

Anyone who could have watched this ridiculous patronizing of a 9 year old child who was confused and scared out of his wits, without developing a deep sense of disgust for the step family, is obviously just as uncaring, cold, and manipulative as they are.

In one interview David Goldman was asked if Bruna wanted to live in Brazil why didn't David move down to be with them. If I am not mistaken, that was not an option on the demands from Bruna. Yes, every parent should go to the ends of the earth for their child, David Goldman could have tried to live in Brazil - but if he did that he would have given up his rights under the Hague Convention. He was really in a no-win situation but to wait out the slow court system. As for the money, come on people, if you go to court and win, the loser pays for all the fees. That's 3rd grade knowledge - please don't tell me Brazilians are only educated up to that grade level?

David has been fighting for his son ever since he found out Bruna kidnapped him. And nothing was sold to CNN or NBC. Nothing. Recent interviews with David and his attorney dispelled that myth. No deal has been made.

Do you really think they didn't already have return tickets for Sean before NBC made their last minute offer to let them ride back with them on their private ject? They accepted because it gave them more privacy, which is what was best for the boy after being hauled through a mob of cameras by his poor excuse for a stepfather.

Seriously. Brasilians have no more excuses to be stupid and intllectually lazy. All of this is verifiable if they are willing to steer their minds away from Globo and Record.

I was riding past some of the favelas in Rio on my way between Copcabana and Barra. I was safe in my bus, but there are millions of people living in these slums. The authorities here say that it is a haven for drug dealers and criminals. One of the flightattendants on my flight down said some of the drug lords have offered a $10,000 bounty for killing a policeman.

But these things are as close to hell as you can live. At least from the outside they look like it.

Imagine if you can buildings made of sheets of plywood randomly tacked together. Cover that with cardboard and a corregated tin froof. Then cover all that in about nine layers of ash from burning trash. Set it next to a foul ditch filled with sewage, tires, oil, and other unsavory matter.

Then add the desperation and contrast of the poverty these people live in to the wealth of the rich in Ipanema. And the mosquitoes - can't forget the bugs.

But right in the middle of it all was a giant gleaming stadium built for the Pan American Games and named after Joao Havelange - the former head of FIFA.

Real life smacks you in the face sometimes. Today was one of those times.

I believe that Sean was being MOLESTED by his Brazilian stepfather. There is a good story here that Americans should not marry anyone who aren't stable enough especially when little children are involved. I'm writting a children's book and there will be a character that was sent from the deep pits of hell and her name is Bruna Bianchi to hurt baby boys and girls she and her bitter mother are the servants of the devil. SEAN IS HOME AND IT'S GOING TO TAKE ALOT OF MONEY TO MAKE HIM A NORMAL KID AGAIN. But if I were David Goldman I would get my lawyers to go to court and issue an ARREST WARRANT FOR THE LINS e SILVA AND THE BIANCHI ABDUCTORS. May they all rot in hell.

Everyone, and I mean everyone! should be thinking and concentrating their energy and thoughts on this poor boy, so much traumatised and exposed so early on to life cruelest events! For God's sake! He Lost his mother! This is no small matter for a child! NO one seems to consider that whatever the mother, all children have a strong bond with her! Immediately, the real mother gave up of her appeal. This is love! and this is the one thing we should be talking about. Love, compassion, forgiveness, understanding. This case should become a touchstone to resume all these feelings toward children! Let us love more and hate each other, attack each other gratuitously! What for? What the benefits are and fro whom? The main losers are this boy, his half sister, and his entire formation as person might be seriously compromised.

In this story of Sean what is concrete is that David had Guillain-Barre syndrome, which Bruna died mysteriously and that the Brazilian family hates David. The Guillain-Barre Syndrome is recognized as one of the consequences of HIV infection. The rest is staging and theater.

Why are people still arguing about this? The case is over! A little boy was kidnapped from his father, the mother died, and now he is back with his father, the only surviving parent. End of story.

The Brazilian family can waste as much money as they want in Brazil courts. Sean is now in the jurisdiction of the US, where the courts and international law will both back the father. Instead of facing this reality and trying to make peace with David Goldman, which would obviously be in the best interests of the child, the Brazilian family continues to smear Goldman's name, and in the process, hurt his child.

I'm convinced the Brazilian family doesn't care at all about Sean. They are outraged because despite all their money and power they lost and didn't get their own way. That is why they continue to fight. But Sean is already where he belongs and no amount of spiteful, childish behavior is going to change that.

Sean will be fine. He’s young and resilient. What needs to be dissected now is how this family manipulated the courts and media in Brazil. Then we need to see what can be done to FIX the system so that an episode such as this cannot happen again. At the very least have it well documented so that others whom fall prey to such a corrupt and influential family are armed with the best information. Burying your heads screaming la la la la la la la will not help others in the future.

I don’t understand this “OH ITS OVER GET ON WITH IT” crap. Lives are at stake, and there are 60 other pending cases in Brazil. Although many in Brazil are use to rolling over and accepting whatever is done to them, others around the world analyze these experiences and then fight for changes in laws to close loop holes so that others don’t have to suffer the same ilk of corrupt thuggery. An interesting idea in theory, but this is an emotive case involving nationalism and parental rights. Separations are almost never amicable, let alone honourable. Millions of people were brought into this story, from the US and from Brazil because the idea of being able to manipulate laws so readily, especially with an open and shut case involving a child removed from his father was unacceptable for them. Especially for the many foreigners currently married into the Brazilian culture. This story terrified them!

Let us not forget that he does have tow families, that is, uncle, grandparents in Brazil and US (not only US and not only Brazil that must be clear) and that he does have a sister. Does it mean anything or not anymore?


It does mean LESS given how he was manipulated by one side of the family. Cruela da Vil made her bed, now she must lay in it. If she hadn’t banned David from seeing his son, if she hadn’t coerced her daughter into abducting Sean in the first place, if she had acted like a human being instead of an “I get anything I want” harpy eying the fluffy soft prize to wear, none of this would have unfolded as it did and Sean would have probably had a great life travelling between the nations and getting the best out of two interesting worlds.

No, she had to gamble and bet it all. Now she is left holding nothing. A lesson that needs to be highlighted for others OVER AND OVER AGAIN. Maybe one day, it will start to sink in with those who think they can purchase anything.

let me see:
1- to have a family in Brazil means nothing. A legitimate sister means nothing, except when both brother and sister are able to decide what to do (how to go about it) with their relationship based on their maternal bond...but that can wait for some long years...until there, they remain apart as if both dont exist for each other. 3 - yes, separations are never friendly (sometimes it is very cruel, EVEN if it is among people from the same culture, skin color, religion, race, economic status...I need no lesson on that) But separations involving children need not be like that, especially (and more importantly) involving people from differnt backgrounds, different countries! How much harm can be caused, how much stereotyping, preconception and prejudice can arise from bitter issues made so unashamedly public, such was the Goldman case...or merchandised as if the boy was some kind of money box. All cases involving parental rights from people from different cultures should be treated more discretely and not be at mercy of international voyeurism and curiosity. The law is the law, but asserting that DOES not mean that legal fights should also be fought publicly. That must be applicable to ALL sides involved. IN PARTICULAR when there are children involved. Period!

4 - as for BOTH families and relatives still alive: time to focus on the boy's happiness. NO one lives out of past issues...if they do, their lives are bound to be a collection of of bitter moments of mutual accusation. Both families need to find a solution, a common ground. Bitterness, hatred and the past will not help build a better future.

No question about the paternal rights to the custody. This is clear to everyone. But, in cases, like this one, especially now that one parent has died...many truths will be never known. It is sealed forever in between four walls. Only the couple know it and one of them can no longer defend herself. Let us at least respect that, respect the bond between mother and child, and move on!

There are things that people can not but confess that we can conclude with concrete facts. David Goldman was hospitalized because of a Guillain-Barre syndrome. This disease always happens with people with HIV. Thus we can conclude that David sent the virus to Bruna who died some time later. Marta is visible affected by the fact that Brazil, my country, is beautiful. Yes, it's beautiful, but the violence prosper and the authorities do nothing to stop criminality and most of our politicians are bilionaire, many scandlas and no punishment. It's very rare to see punishment in Brazil, and the laws are good but alow the unjustice be abusive and cruel. People are murder and they receive few years with many priviledges in prision and soon leave and move their lives on, what their victims lost all.
I love my family and friends in Brazil. There are a bunch of people with precious heart but there are a bunch of xiitas, those that are always on the other side of the ethic, moral, goodness, and the best Marta is to recognize that our country has a ugly side (that doesn't means that even US don't have, because we know). This is about people. This is about reunite the family : son and father. My parents were poor, but I would never exchange a thing. They were wonderful parents and so many I know that are riches have no respect and are a shame. The Brazilain family has to pay the bill (money)to repair the damage: five years lost in this insane , sureal, unfair war. It's so common in Brazil Imagine that the Brazilain government gave away millions to the terrorist that intended to implant the communism in Brazil. Today more than hundread were granted for any reason than to fight in their country against the democracy, against their own people.

I never read about this in any national newspapers that have been covering the whole drama . It is news to me, though I thought the circumstances that surrounded the death of Bruna were never fully clarified.It is rare these days for someone to die giving birth to a child, especially when the lady can afford expensive medical care which Bruna did.

If this story is true, all we can do is to pray for the welfare of Sean and his half sister. It is rather sad, isn't it?

People, can we all just step back a bit and try to read this as a simple human interest story with NO bad guys?
Start by assuming that David and Bruna fell in love and got married and moved to NJ and had Sean. Then, realizing that the marriage was NOT made in heaven, they fell apart, Bruna flew back to her mother's home, a perfectly natural reaction. She took Sean with her, and cared for him, as did her mother. David fought for custody, as would any father who loves his son. Bruna fought for custody, as would any mother who loved her son, and the battle was fought in the Brazilian family courts. Which, unsurprisingly, misread the Hague Convention clause that, under certain circumstances, expressly permits a child to remain where it is if it is accustomed to the new home. Which Sean was.
Bruna divorced David, fell in love with a Brazilian lawyer, and married him. He, in turn, became a loving stepfather for Sean. David had not appealed the Brazilian family court judgement awarding custody to Bruna because (a) he had visiting rights; (b) he realized Sean was in a healthy environment with people who loved him; and (c) his case in NJ was pending.
Then everything changed. Bruna died in childbirth. Bruna's mother, as is extremely common in Brazil, became a surrogate mother rather than a grandmother. And fought for Sean's custody because she loves him. And David, his father, fought for Sean's custody because he loves him. And they fought (this time) in Brazilian Federal courts, where the Hague Convention is taken seriously. And David was joined by the Brazilian Solicitor General's Office (AGU) which knows that there are Brazilian children who have been taken to the US, and that if Brazilian courts do not honor the Convention, neither will US courts.
So far, NO BAD GUYS, other than the Brazilian lawyers who enlisted the local press to "keep Brazil from deporting a Brazilian baby" and the American politicos who enlisted the press there to "make sure Brazil doesn't kidnap an American baby".
But the truth is, Sean has been raised in a loving family, and will be raised in a loving family with his father, and, in the best of all possible worlds, will have access to both families, in both countries.
Both of which are beautiful. I know, I'm an American who has lived in Rio for 33 years, and my Brazilian wife's best friend from college in the US lives in Tinton Falls NJ--as, now, does Sean.

I know, I know, this is not the story that has been ventilated in splenetic fervor by most bloggers on the subject, and there is a certain Candide-ness to it. But, if you dare, step back and assume that everybody involved was really, truly, hoping to vindicate Sean's right to the pursuit of happiness.

And agree with me that Sean deserves to live happily ever after.

I am not buying it as yet. Why don't we let Evelyn to present her proof? Gut feeling? You might say so. Right from the beginning, I thought that the issue became a high profile case because of the people involved are well heeled. Nothing about the other 63 kids held hostages against their will. In case you do not know, the Brazilian laws always favor the women and IMHO, the lower court judges don't know anything about the Hague Conventions!

What really upset me was that the media on both sides of the Equator played it as a pissing contest between the U.S. and Brazil. They never mentioned about "Father´s Rights" or hundreds of thousands of American and Brazilian dads who are in the same situation as that of Goldstein and they are also suffering and cant do much about it because of lack of financial resources to fight out their causes in the courtrooms. Fine, now Sean is reunited with his biological father. Whether he is going to be happy or not, only the time will tell.

Custody battles are nasty all over the Western World. Unfortunately, those who have plenty of money win them eventually. Do you contest my statement?

I'm sorry to tell you that it is difficult to defend David Goldman. You need more information about HIV and AIDS. In America there are a lot of information and research on HIV and AIDS. Many Americans are living with HIV and often lie to their partners. Frequently, they say they have other diseases to hide the truth. Orphanages of America are filled with children born with HIV because their parents had a life of promiscuous or were drug users.

I'm sure by now that most of you saw the Dateline special tonight. Those that thought they knew what they were talking about really don't. Brazil may be a beautiful place but a child was emotionally abused by people who used their political bullying to take something they had no right to take... a child away from their parent!!! Bottom line is Sean is where he is suppose to be and the brazilian family needs to let it go. David took on the battle and in the end won the war!!!

This thread is enough to want to make me laugh at Brasil. Fortunately I realize that Andrade, Marta and the rest of the bigoted, uneducated, uninformed posters in this thread aren't representative of the entire populace.

This kind of third-world thinking from third-world participants in a third-world education system is what has held Brasil back for many years. Of course, this post will now generate another batch of ill-informed comments about how Brasil is no longer a third-world country--which everyone outside of Brasil knows is not true. That's largely because Brasilians believe that by thinking something, it becomes true. The reality, of course, is that pompous pronouncements and hubris do not turn a third-world country into a first-world country.

Brasilian ranters really need to learn how to think in an ordered fashion and learn how to structure an argument based on fact. Andrade et al, I suggest you read forums elsewhere to see how it is done.

If you have watched the story of how this innocent little boy was taken from his father, I don't understand
how anyone could justify the act. The mother took the little boy from his home and moved to a different
country! When the father (David) realized that the mother was not going to bring him home immdediately
hired a lawyer. Even the mother had said in taped phone conversations that David was an amazing father. It
was the government of Brazil's responsibility to send Sean home and they didn't. Obviously the Brazilian
grandparents are wealthy, and I am sorry but that is everything in Brazil. David was the biological father,
that can not be disputed. That was his son, and is his son and always will be his son. I think it's disgusting how that family tried to keep the father away from a little boy who clearly loved his father! Shame on them and shame on Brazil!
