American ship Lord Jim The story I'm about to tell is important reading for any Brazilian who loves this great country and wants it to move forward on a good path. The story is also a warning for any foreigner who visits Brazil, especially by boat...

My husband and I and our Australian shepherd Moana arrived in Angra dos Reis, Rio de Janeiro, in October 2006 on our American schooner Lord Jim and spent nearly 6 months cruising various islands in the exotic Costa Verde, including the famous Ilha Grande. This is a beautiful area for relaxed sailing and served as a good resting place in the middle of our circumnavigation of South America.

Unfortunately, tragedy overtook us when in early March 2007, as we were exiting Brazil to make the next leg of our voyage to the Caribbean, we struck an unmarked rock in the Baía da Ilha Grande, and sadly, our schooner sank.

With the amazingly speedy help of the local sailing community of Parati, we got Lord Jim floating again within 48 hours and through other good Brazilian friends we found a boat yard which could haul the boat for repairs.

Lord Jim is an 85-foot gaff-rigged schooner built in 1936 in New England, USA; she is built of wood and has a traditional deep lead keel. The only boat yard in the area to which we could safely tow and which could accommodate the deep keel is in the small town of Mangaratiba, about 100 km from Rio de Janeiro, so it was there we towed and hauled Lord Jim on the 16th to 18th March 2007. We are still here, July 24, 2010, held hostage by a Brazilian crook named Luiz Prado.

We made a contract with Luiz Prado who runs a boat repair business named Renaman with his partner, Daisy Meanda, who is the actual owner of the boat yard. Because we could not speak Portuguese at the time, a good Brazilian friend of ours helped us with this contract, which the two parties signed in April 2007 and the work began.

The actual sinking of Lord Jim was the result of a sprung garboard plank, the opening of which was caused by the pounding on the rock, but as we surveyed the hull we found more floors and frames which needed replacing (all of this technical boat building can be explained elsewhere and all the phases of the job are thoroughly documented with photographs and written records).

Luiz Prado was very encouraging for us to undertake a more thorough structural rebuild as he told us he was able to supply excellent quality Amazon hardwoods for the job via his other business, the Madeireira Litoral Fluminense do Sul. The contract which both parties signed included a time frame of 150 days for which we paid diárias (daily fees like parking) and Luiz Prado was to supply the materials.

The first large wood order arrived in early May 2007, for which Luiz Prado demanded that we pay in one lump sum, which we did. Suddenly on June 1st, he stopped all the work on Lord Jim for 2 weeks, the reason for which was totally unclear to us at the time. He was claiming we were not paying him according to the contracted agreement under which payments were to be made every quinzena (every 15 days).

However, we were paying him on schedule which included a payment we made that very day, June 1st. There are documented bank records verifying our payments accordingly. This work stoppage was the beginning of many and also the beginning of our realization of the nightmare we had unwittingly subjected ourselves to and from which there was to be no escape or as yet, no resolution.

For the next several months the work proceeded with many of these inexplicable stops and starts. Each day we went to the yard to work on Lord Jim we never knew what would happen; would our carpenters be allowed to continue their work on Lord Jim or would they be taken off the job and made to work on Luiz Prado's boat, Larus, which he "happened" to be rebuilding at the same time from a wrecked state and "happened" to finish long before Lord Jim was finished.

Luiz Prado continued to sell us wood, some of which was worm eaten and unusable. The final wood order of cumaru for the planking he sold to us was green and wet. It could not be used for six months at least, until it had dried sufficiently, and this during rainy season!

Our carpenters were from Belém, Brazil's wooden boat building capital. They are indigenous Amazon Indians and primarily used in this specific industry, to our understanding, in a system not too different from the "indentured servitude" practiced in the feudal ages.
 
Luiz Prado finally took away our three Belém carpenters permanently by the middle of October 2007 and thus all work on our beloved Lord Jim came to a screeching halt. The next thing we knew was Luiz Prado had filed a legal suit against us for perdas e danos (Losses and Damages) in the amount of more than 500,000 reais (close to US$ 300,000 at today's rate) on January 8, 2008.

Our Brazilian friends recommended a lawyer from Rio and she and her partners became our only allies working to get our boat back in an increasingly vicious battle on the part of the Prado family. Not only is Lord Jim our home she is also the means by which we make some income through chartering to people who want to learn the skills of high-seas sailing and experience the vast and potent essence of our earth's oceans.

We are nature teachers of sorts, we do "sail training" or adventure sailing for people who want to participate in long distance blue water voyages on a traditional schooner. Actually it's a whole lot of work and a unique eye opener to our magnificent and precious planet.

Anyone who has become embroiled in the justice system of Brazil will understand why our Brazilian friends strongly warned us not to get involved in a legal case. However, we had no choice. Luiz Prado was after us and we had to respond to the processo (suit for damages) he had filed against us or we would be found guilty.

Anyone who is familiar with the Brazilian justice system will also know that it is very slow. In our district of Mangaratiba, there is only one judge for the approximately 50,000 residents, a vara única, and judges come and go. Five judges have "handled" our processo in the time span of 2.5 years.

The first judge ruled in our favor that we hire a company of our choice to complete the structural work on Lord Jim. Again with our Brazilian friend's help we signed a contract with a company in Belém who furnished us with 3 Amazon carpenters and 2 caulkers.

They worked from August 20th until December 24, 2008, finishing the structural work designated in the original contract. Meaning, if Luiz Prado had not been trying to steal our boat in the first place by continuously delaying the job and trying to drive us out of Brazil, we would have finished all the structural work reasonably close to the contractual time frame of 150 days.

In the meantime, when we first arrived to Mangaratiba in extreme shock and bewilderment as a result of our disaster, Luiz Prado offered us a small apartment in the downstairs area of his home (a compound really) to use for storage of all our personal belongings and the boat's spare parts, of which we carry a lot. We agreed to his rental price of 500 reais (US$ 285) per month for this small pair of rooms which he designated as Casa 3, although it had no direct access to the street.

Next he offered us the larger one-bedroom apartment upstairs for us to live in while the boat was being worked on. We signed a one year rental contract for 1,200 reais (US$ 683) per month for both casas 2 and 3.

With the work stopped on the boat since October 17, 2007 and the civil suit brought against us by Luiz Prado in the name of his company Renaman in January 2008, our lawyers next found that Aparecida Prado, his wife, had brought an eviction suit against us on August 20, 2008.

Fortunately, one of our lawyers specialized in real estate law informed us that the rental contract we had signed was written illegally and we had renter's rights to remain in our rental for 30 months.

So we decided not to move at this time, since the work was beginning once more on the boat and we needed to be in the yard every day. Luiz Prado could no longer lock us out and keep us away from our property, our boat.

The first two Belém carpenters arrived from Pará by bus August 17, 2008 and were supposed to be allowed by the judge's alvará (order) to stay on the boat in the yard. Luiz Prado would not let them stay in the yard, so we decided to let them stay in our small storage suite, Casa 3, underneath our apartment, Casa 2.

On the second night, August 19, the men were downstairs cleaning up to go get something to eat when we heard a commotion going on. We went downstairs to see and there was Flávio Prado with a large shovel threatening the carpenters, ordering them to leave our rented suite immediately. (Flávio is the oldest son of Luiz Prado and his wife Aparecida, and also attorney of record for his father).

Along with Flávio was his youngest brother Daniel and both parents were standing in the background. When my husband tried to approach the carpenters to see if they were OK, Flávio and Daniel both attacked him: Daniel shoving and pushing an iron bench against my husband causing him to lose his balance and fall onto the concrete of our patio and then Flávio slamming the shovel blade into my husband's left foot while he lay there on the concrete.

Is this normal behavior of a Brazilian lawyer, an officer of the court? By the way, my husband was 70 years old at the time...do Brazilians always attack two or more to one? Do Brazilians always gang up on older defenseless foreigners?

I managed to get my husband to the local hospital to finally receive a dozen stitches while unbeknown to us, Aparecida Prado had rushed to the delegacia (police) reporting herself as the victim of a home invasion by my husband. We also had to find a pousada for the night for our two carpenters. And the next day, August 20th, Aparecida Prado filed the eviction case mentioned above against us.

The next case Luiz Prado brought against us was a medida cautelar, like an arrest warrant, to hold the boat as collateral in the event the judge did not rule in his favor and we would somehow "flee" Brazil with our boat even though the repairs were far from completed. This was in March 2009 and the current judge of the time categorically dismissed this request for "arresto".

In the United States we are protected against what is known as Vexatious Litigation, which means the repeated harassment of an individual with false lawsuits designed especially to be detrimental and with wrongful purpose. It is against the law in the United States. Apparently a similar law does not exist in Brazil.

The final decision of the judge on the processo was handed down in November 2009. The sentence was not in the favor of Luiz Prado, he was not awarded 1/2 million reais in Losses and Damages.

Immediately Luiz Prado appealed this decision, his son Flávio entering a recurso (appeal) in the local court in December 2009. Our lawyers responded with a recurso on our side in December 2009.

There was a prazo (time schedule) of 15 days beginning in January 2010 when the courts reopened after the New Year holiday for these recursos to go to the segunda instância (the Appellate Court) in Rio de Janeiro.

We have waited more than 5 months for this transfer of the processo and the companion recursos to take place...finally on June 30th 2010 the entire case was sent to Rio, and has been published as of July 21st, 2010 by the Tribunal de Primeira Vice-Presidência, Rio de Janeiro.

While we were all waiting for the judge's decision in 2009, Luiz Prado tried another form of what we consider blatant extortion. We knew the rails in the water were purposefully destroyed (this is more fully explained below), we could witness daily the continuing deterioration due to total lack of maintenance of the cradle and ways that support Lord Jim out of the water, and the judge had already dismissed the arrest warrant of the boat in March 2009.

In May 2009, Luiz Prado sent his brother-in-law, Humberto Vaz, also a lawyer, to meet with our three lawyers in Rio. This meeting was about money and Humberto came to "offer" our lawyers their solution to the "problem" in advance of the judge's decision.

The boat would be allowed to go back into the water if we paid Luiz Prado the amount of 110,000 reais (roughly US$ 63,000). Our lawyers categorically refused to comply with this type of demand, saying we would await the decision of the judge.

Why continue to throw good money after bad when Luiz Prado's track record only showed him to be a man of zero integrity. How could we have any confidence in someone, giving him more of our money, who had deliberately destroyed his own equipment in order to hold the boat hostage? We had lost our trust in Luiz Prado a long time ago. There isn't an honest bone in this man's body.

The ultimate heart-breaking, mind-numbing fact is that the legal case Luiz Prado brought against us is about money, money, money and Lord Jim is essentially free to go. Luiz Prado refuses to launch our boat even though she has been ready to go into the water since January 2009. He is holding our boat for ransom, thereby essentially holding us for ransom. We are hostages in Brazil by virtue of outright and condoned theft of property.

Sometime before the work recommenced with our new carpenters in August 2008, Luiz Prado had the trilhos (the rails) destroyed. Trilhos are train rails upon which the cradle structure, which supports a vessel out of the water, rests. The trilhos run down into the water and they were obviously in place when the boat was hauled out.

They had to be disassembled by a human being with a large wrench, otherwise there is no way the large bolts which hold the rail pieces together could come apart. Brazil does not experience hurricanes, earthquakes or other types of natural disasters which could perhaps destroy these rails.

More importantly, Luiz Prado has done absolutely no maintenance on the carreira (cradle) in which Lord Jim rests for the entire time the boat has been in the boat yard and it was in a ruinous operating state when we first arrived. Of the 8 required braços (arms) there were only 5 in place when we hauled out; during the first round of work (July 2007) the carpenters took off one braço on the starboard side leaving only one braço in place and never replaced the one they had removed.

During the second round of work (September 2008) one of the portside braços broke off because the metal hinges had totally disintegrated due to corrosion.

Lord Jim weighs 70 tons, it took 3 attempts to pull her out of the water in March 2007 because the steel winch cable broke twice. Lord Jim is now in grave danger of falling over. Someone, like us, or another client or a yard worker could be fatally wounded, not to mention, our boat, our home would be most likely destroyed beyond repair.

We have gone to every agency we can think of for help as we continue to learn how things work (or don't work) in Brazil. We started with the US Consulate, of course.

They know all about us, that we sank and are struggling in a foreign country under the onus of a foreign language (of which we are now fairly fluent), trying to save our boat.

Lord Jim is a US Coast Guard documented vessel that served in the Second World War on submarine patrol in the Atlantic Ocean. She is an historic topmast, gaff-rigged American schooner that has sailed around the world four times under her present owners.

The US Consulate said they couldn't intervene in a civil suit and then when we went to them in fear for our personal safety after Flávio Prado attacked my husband with a shovel, they told us to go to the polícia federal.

The polícia federal in Angra dos Reis knows us very well. We have gone to them regularly in order to make sure that our extended temporary permanence in Brazil was and is completely legal. We have kept them and immigration updated on a regular basis as to what has been taking place in Mangaratiba with us and our boat.

The polícia federal sent us back to the delegacia (special police) in Mangaratiba when we expressed our fears for our personal safety. We also went to the mayor of Mangaratiba who at the time said he could do nothing to help us since there was a civil case against us in the primeira instância (the local lower court).

We are hoping to see him again this coming week. Apparently it is the prefeitura which hands out the operating licenses for local businesses and we are hopeful that they will intervene on our behalf.

We have gone to the Marinha (the Navy of Brazil) to tell them of the serious danger there is of Lord Jim falling over and someone getting killed. They allowed us to make a formal complaint and immediately sent two inspectors to review the conditions of the yard.

Apparently there is a report which will be sent to the delegacia (police) or else a similar report will go to the mayor's office, although we are not at all clear as to what influence their investigation will carry as far as Luiz Prado and Renaman goes.

We use an expression called "passing the buck", whereby one agency hands us off to the next and ultimately no one has any jurisdiction or is willing to take any responsibility.

Apparently, property theft in Brazil is condoned by all agencies and governing bodies. In addition to the above efforts locally, we have sent letters to Thomas A Shannon, Jr., the United States Ambassador to Brazil; to Hillary Clinton, US Secretary of State; and to our 2 California state senators, Barbara Boxer and Diane Feinstein. As yet no one has intervened on our behalf.

Our story has been published by several international sailing magazines in the early years of our disaster like Velejar (Brazil), Latitude 38 (USA), Voile et Voilières (France) and Yacht (Germany). In the latter part of 2009 we managed to get several Brazilian publications interested in our story. Daily O Estado de S. Paulo and weekly magazine Época were some of them.

Our only salvation at this point is the media. If there is anyone out there who can get us television exposure with Rede Globo this could well be the turning point for saving Lord Jim.
 
If Brazil is planning to successfully hold a World Cup in 2014 and an Olympic Games in 2016, saving Lord Jim might serve a very special purpose in these ventures.

If Brazil wants to become part of the First World which I have heard president Lula express, then correcting the corrupt and deplorable situation that has befallen a retired married couple who came to Brazil simply as tourists might be a very important gesture indicating that this great country is well and truly on its way to becoming the "new Brazil."

By the way, our Australian shepherd, Moana, died last year (2009) at the Hospital Universidade Rural in Seropédica, Rio de Janeiro, and she is buried here in Mangaratiba on the land of some wonderful Brazilian friends of ours.

On a serious note:

1) Her story on "Lord Jim" sounds very much like that of "Roam Deep".

2) The experience with the contractor she hired to fix the boat is very similar to that of many, many Brasilians in dealing with large and small construction companies while building or repairing homes.The article that talks about the "Perils of buying under construction property" describes these "intricacies".

3) Even while hiring a lawyer, one has to be careful these days. You really don't know if he/she is working for you or your opponent.smilies/shocked.gif

It's sadly not just foreigners who fall into these traps (although they are the preferred target of scoundrels, especially the elderly) but there is simply a crap load of ignorant ruthless yobs in this nation that lack any sort of empathy and think they are owed the world, and go about their days simply making the lives of others miserable and trying to take what is not theirs.

They flourish for two reasons, firstly, Brazil's bloated and retarded bureaucracy makes for a sticky and dangerous web where these societal pests sit in wait for victims, and secondly, the acceptance by most Brazilians that it's just a normal part of life in Brazil and they live with it and live watching it happen to people around them all the time. NO reaction, no anger, just "ah, isto eh Brasil" a shrug of the shoulders, and back to drinking SKOL and watching football, or soap operas.

It's a nation of sheep. Sorry, but true.

If the writer of this article is a documentary film maker, she may wish to produce something about this in video and send it off to the networks in the USA. I have heard of numerous stories just like this where a corrupt SOB, using Brazil's shameful bureaucracy to con and ruin the lives of genuine nice people.U sing her time while hear to show this would probably help her more than the written articles.

Once the Sean Goldman case made it to American TV news the nation had to clean up its act. They won't win this on the ground here in Brazil, it's too corrupt, and the judges are useless as are most of Brazil's agencies. They'll have to shame the government into doing what is right and getting involved, and to do that you make noise in the US. Trying to solve it through the courts here, or sites like this one, will get them no where.

It's a sad story, and shouldn't happen to people who worked their whole lives to retire and enjoy the world.

Shouldn't happen, but sadly is happening in this country. What is the point in creating laws that are supposed to protect the "elderly" and not enforcing them? If people think that the ill treatment meted out to the elderly is restricted only to the "low income group", they are absolutely mistaken.It happens mainly to the "middle class retirees" who "worked through their entire life honestly and want to enjoy life" in the autumn of their lives.

Since Lord Jim was used for submarines patrols in the last world war, eventually Brazil wants to nationalize the ship, as is, just in case America wants to invade Brazil with their nuclear submarines!

Eventually Lord Jim owners should write to Obama. Has he not said that Robbing Hook is HIS man ?
Or why not directly to Robbing Hook ? But the risk will be that HE may then accuse Lord Jim owners of being spies and keep them hostages in the country for a few more years !

Excuse me, Komrad. Lets not start a pissing contest between the Americans and Brasilians by deviating from the main issue: Lack of Business ethics and exploitation of honest elderly people. Our distinguished fellow blogger Gringo2 wrote my line of thoughts in more eloquent terms.

BTW, Lord Jim is a beautiful ship with rich history and I would hate to see it being lost to the predators and meet an ignominious end.

Being a great admirer of ancient culture, artifacts, etc;, I hope and wish not. But...but...but..., the "crooks" don't care, as long as they can make extra bucks or just to demonstrate their "manhood". The recent examples I can cite are the a) Taliban blowing up the Bamiyan Buddha statues b) The Americans taking out the ancient Babylonian treasures out of erstwhile Mesopotamia .

Dear sir, are you implying that the U.S. military looted these treasures? Can you produce a link or any evidence (besides Al Jezeera) supporting that or is your statement based on the U.S. military not protecting them sufficiently while they were looted by who knows who?
Also, the destruction of the Buddhist statues serves as a perfect example of what the free world is fighting for. What did the Buddhists ever do to anyone to deserve that? If Brasil wants to be considered anything other than a third world joke internationally, then it needs to get its legal system in some sort of order and free from ridiculous rulings, frivolous lawsuits and corruption. If a country does not have a free and fair rule of law, which protects everyone without fear or favour, then it has nothing.

What a totally ridiculous and wrong situation this is. It is the boats OWNERS who should have been able to sue the boatyard owner for doing NOTHING that he agreed to do in the first place. Honestly, until Brasil can get a legal grip on its bandits, it will remain a joke internationally and will NEVER be considered a place to do business by the international community. Perhaps Brasilians might start demanding that their politicians actually DO something for them? We see all of these faces on posters and vehicles, and stupid vehicles driving around the streets blaring out loud music and telling them who to vote for each election time, but what are these characters DOING when they get elected? Jack-squat is what I see...

They would not stand for this kind of rubbish in Europe, or America. Right is right, and wrong is wrong. It really is that simple. Why do Brasilians put up with these bandits being allowed to do whatever they want? and their ´politicians´ doing nada?

Steve, almost every thread on this site turns into Yankee bashing. Personally I have plenty of problems with how the U.S. is being run these days, but that is in comparison to the country I knew way back in the 60s and 70s.

Still, with all of the problems in the U.S., it's a far superior environment to most. Crooks? They're everywhere, but you are correct, in Brazil they use the legal system. It favors the crooks.

Not good for international development. People in the North America and Europe know this. If the legal and political system in Brazil were better, there would be a lot more tourism and investment than there currently is.

Back on topic, the hands of justice are notoriously slow in Brasil. It's hard to believe anyone does not know that simple fact. Of course those hands can sometimes be "motivated" a bit if one were inclined to do so.

The principle problem with the non-performance or less than timely performance of the contractual obligations are most likely rooted in the portuguese version of the document itself. The misfortunate couple probably has no leg to stand on within the court system (if they even mangage to get it all in there for a hearing) and all the other apparently malicious / malefeasiant activity would be matters to be held separate and dealt with independant of that anyhow. Wouldn't matter one iota if any of all that were commonly thought of as being something that was just not right / having some material impact as to fiscal matters, lost income, added expenses, etc., etc., or even being something that in and of itself was tacitly illegal.

You can do whatever the heck you want to do in your own backyard but doing anything at all in someone elses physical domain is ultimately up to them to give the nod to. Even if the crook was adequately and appropriately covered financially for what he did provide for services, materials, labor, other resources, etc., although they did not know it, they were screwed right at the point where the hulk was no longer in open water.

When he's let out of seclusion, we should perhaps inquire if Forrest would do the honors of providing security patrol and escort to safe haven when launch time comes. And hopefuly his dear Fatima will oversee the serving of a fine high seas luncheon aboard! If by chance some political parties can be induced to attend it would be a grande celebration (and a good target practice opportunity).

I agree what happened to this elderly couple is shameful. And although I vacation in Brazil regularly and love the country and it's culture and people, I know Brazil well enough to realize to never get involved in a business dealings in the country. I do not know enough about Brazilian politics to criticize Lula or his people. One thing Lula has done is to place Brazil in a highly visible position with the World Cup and 2016 Olympics. Brazil is wealthy but unfortunately it's leaders with a few exceptions, lack mental discilpline it takes to handle success as a nation state and steer the country as productive and leading member of the community of nations. The country's social problems are so deep and intractable that it will take Brazil several generations to right itself. It has to route out corruption in it's Federal Military Police . It also needs to revamp and bolster it's educational system. This will take many generations. But Brazil can do it. It must if Brazil wants to take it's rightful place among the world's leaders.

Getting the money is getting the money and it matters little to most whether that is done right and honestly and for "value" in return or it is done by whatever twists and turns on the words, ignoring what's commonly known and intended between the lines, or even trying to take outright dodges that seem to be available to get out from providing what was reasonable and expected in return for it.

Rule 1: Pay only "after", Step 2: Pay only a part of what is due for whatever excuse you can make up. Saying I'll pay you or I'll do such and so tomorrow is a good tact - tomorrow never comes. Like a French race car driver, what's behind you doesn't matter once any part of the money has managed to get passed into the hands of the deep seatedly crooked people. You can call them "tough negotiatiors" if you like - the "dance" they do is simply incredible and from time to time somehow bizzarly impressive / to be marveled at. Poverty doesn't drive it, it's more like being half a capitalist and half a (fill in your own blank). Forrest, very glad to see you post again but I think your wise advise is a bit late. To "go brasilian" on someone and their family has to be done quickly and silently. I think this couple has made your own mistake and pushed things up in the faces of the the authorities and fractious "court system" as it were. Also you missed mentioning taking the traficante route - be sure your gunmen are underage. You might need a few of them instead of just one as with their lack of experience you might loose a few - that's okay as they are much cheaper anyway.

Glad to hear your ship was finally located OM. If by chance my "spotter" and reporting activities helped lead to that, maybe a little jeitinho brasileiro is in order. When can we move in next door to you?

Shoulda, woulda, coulda isn't going to help asp. As this poor old couple have no home to go back to, just walking away at this point (which would give them the best possible outlook for their remaining years) is not likely an option for them. If they happen to live long enough to make things right via the authorities and court system they still will need bushels full of cash to grease the skids with the two, three, five offices that will magically appear on the scene at the end to claim the responsibility of whether to declare the rotting hulk as being adequately seaworthy (or not being so) so as to allow it to be "safe" to be afloat in Brasilian waters. Exit route: take first left after terminous of channel zero-zero. Maybe if they do end up cleaning the clock of the yard owner they can take possesion of the yard itself as recompense and turn their pride and joy and source of livelyhood into a unique attraction poussada.

I've been in two situations where I was searching to buy a gun in Brazil. Actually, in one case, the Policia Civil were the ones who recommended that I "find some way to protect myself".

When I suggested to my neighbor that someone should take out a certain person in my neighborhood, he responded instantly "How much do you want to pay...I have this friend P____."

I desisted BUT I keep a machete in my room.

The escalation of cyber inteligence gathering and analyis skills and tools in Brasil has been phenomenal in the past couple years - they got alot of help from folks in the US on that. If it's actually a serious matter, trust me, they can certainly track down and eradicate the bugger. Threats left on the answering machine on the house line are much more scary, I can attest to that. The caotic phone system arrangements there don't much support tracking such crap down, not in the least. Just one more thing that needs serious fixing before 2014 / 2016.

Actually it went a bit further than the internet. Confrontations and a need to move. But it is still a situation in progress so I didn't want to place too much here.

Unfortunately, in Salvador, the police only solve 3% of all murders. Houses are invaded in front of witnesses. No one is going to talk. I've always wanted to have at least a fighting chance if someone storms through the door.

It's a troubling situation...you have the criminals and the police! They like to slap people and I'm very zero-tolerant about anyone placing their hands on me. I've told my friends that if they ever see a PM slapping me....Run!

So I stay out of their way. I do like life.

(not tarnishing all PMs. Four of my very closet friends are PMs and in private they complain about the brutal ones and their incapacity to do anything about it)

Really, these are not situations that I'm sweating. The two cases I've mentioned were in cases where I had been targeted, confronted and there was the likelihood that the confrontations would continue. Interestingly, the laws of the streets have taken care of some of the problems. Many of the folks in question have simply disappeared. That's what happens to young black males around here, they disappear. I don't know what happened to them and neither does anyone else in the neighborhood. I still see two others nearly every day. They hang out with the 'cachaca' group - a group of men who drink cachaca straight all day long. They fuss among themselves but I doubt if they have the strength to do anybody else harm. Another guy had to leave the neighborhood because he messed with the wrong person and is under a 'contract'. (in Salvador, they are as cheap as R$250). No one is complaining. The neighborhood is peaceful. But there's a whole other generation coming up. More police won't solve this problem.

You have to walk on eggshells being involved in the community. We don't have the power to be Machiavellian. You have to assume that you are in an environment that has no law. So, you either minimize the number of people that you anger or you get straight down Machiavellian, assemble your 'gang' and flex your power, if you have that capacity. I Can't do that. A foreigner would deceive Brazilians if they riled them up American style. You have to know your limits. Can't structure in-your-face community projects. Brazilian activists can't even do that. In a real life-or-death situation involving someone, the best you can do is maybe loan the person R$250.

I would love to know more about these conflicts Mr. Lula has solved. Honestly, i do believe Lula has been the best Brazilian president in history, but I can't remember him solving the conflicts of other nations. If this guy has made a lawsuit against the couple, I don't think it's the brazilian system to blame. There must have been some proof against them so that the lawsuit got into force. Besides, everyone in Brazil abide by the brazilian rule of law, in the same way brazilians should abide to the rule of the law anywhere else in the world.

Otherwise, what would you guys do? No U.S. MP has any leverage on the Brazilian legal system. Not even the brazilian executive in any level. If they got nabbed in Brazil, they must get through by legal channels in the same way a brazilian would have to do it in the U.S. So what? The a-bomb? The Dorothy Stang case is sure a polemic. However, there has been a process and there has been a sentence. Though it is not adequate, you can not deny it.

If the US legal system was really effective in comparison, those people seen as responsible for the financial crisis would have already been in jail by some time ago.

A weekend of violence in Brazil has thrown the filming schedule for the final "Twilight" movie into jeopardy.

Brazil is like this in many ways, for instance my wife's father had some land and while he was not looking a crook drew up a deed and sold his land to another. My wife's dad demanded to see the deed and the man had a fake deed. In Brazil you have to pay the guy who was the victim of fraud baught your land in a scam deal. This sounds totally ridiculous but it is true. Since the squatter had been on the land a few years he also had some rights. This is a messed up place legally. In another instance we had a lady in our condo building in Rio De Janeiro who has not payed building taxes for over eight years. The lawsuit is still going on while she gets a free ride on the rest of us!

I understand your struggle, but the best way to deal with it is by scaring them, ill would contract someone just to make hell out of their lives just the way they been doing with your's.
Brazilians are a very different kind of people, the have very very very strong sense of emotions so they would feel worse every time something bad happened to them, i know this is a nice website, but im abroad so i dont care in saying that those people dont deserve to live knowing that they planned (since the beginning) to extort as much money as they possibly could out of you.I think you guys by now have figure out what all this mess might end up, arruma alguem pra da conta disso de uma forma mais energetica.

Eu não sou um cidadão do seu grande país, e assim eu também não sou um eleitor. Mas sou um residente legal e querido na comunidade de Mangaratiba, e assim tem sido durante quase quatro anos.

Como tal, eu tenho um interesse direto no resultado das eleições suplementares para Prefeito, a qual será realizada em 6 de fevereiro deste ano. Este interesse da minha parte é devido ao triste fato que nosso veleiro, a Schooner Lord Jim, foi mantido como refém ilegalmente no Estaleiro RENAMAN, por um membro da comunidade local, que acontece de ser o cunhado de seu cunhado - em outras palavras, muito perto de você através de laços familiares.

Outro fato é que esta triste situação ilegal não é mais um segredo escondido que se desenrola por trás dos muros em torno do Estaleiro, mas foi trazido à luz em parte da imprensa local, a mídia nacional, assim como a mídia internacional. Ela trouxe vergonha para sua família que perpetraram este crime-de-ódio, assim como trouxe vergonha para a comunidade de Mangaratiba. O caso deveria ter sido dirigido pelos funcionários da cidade, logo que tomaram conhecimento, mas não foi. Minha esperança é que quem será o próximo Prefeito de Mangaratiba dará a esta situação a prioridade que merece, e, assim, limpará o bom nome da comunidade de Mangaratiba.

Minha pergunta ao Sr., Sr. Evandro, é muito simples e direta: Você acredita que pode limpar o bom nome de Mangaratiba, se você fosse eleito para ser o próximo Prefeito, e você poderia resistir às pressões que sem dúvida, exercidas sobre você por alguns membros da sua família, ou seja, pelo seu cunhado e o cunhado de seu cunhado? Em outras palavras, você pode assegurar-me - e ainda mais importante - você pode garantir aos cidadãos e residentes de Mangaratiba que limpará essa mancha da reputação da comunidade e posteriormente, irá atender os requisitos do cargo, com imparcialidade e neutralidade em seu julgamento e ações?

Muito provavelmente você vai perguntar se eu estou escrevendo cartas abertas similares aos outros três candidatos que estão concorrendo a mesma posição. Não estou. Se isso estivesse acontecendo na Somália, na Libéria, no Yemen, ou no Gabão o mundo civilizado falaria sobre pirataria e extorsão. Talvez aqui no Brasil as pessoas educadas dariam um nome diferente. No entanto minha esposa e eu nos sentimos mantidos reféns de um caso de grande extorsão.

Eu posso imaginar seu cunhado rir e esfregar as mãos e dizer: ''Agora nós podemos apresentar uma outra ação contra o estrangeiro!'' Sim, você pode, Humberto, sim você pode! Nos Estados Unidos, temos um palavra legal para tal situação, quando um advogado - um funcionário do tribunal - usa o sistema legal para perseguir uma pessoa privada com ações judiciais inúteis e fraudulentas: É chamado ''litigância temerária.'' Por este motivo nos Estados Unidos e muitos outros países, um advogado corre o risco do ter sua licença cassada. Aqui no Brasil a legislação exige tal comportamento ''litigação de Ma Fé'' e é muito mal visto pelos membros mais honrosos do Sistema Judiciário. Mas é claro que isso não tem nada a ver com seu cunhado e cunhado dele que tenham apresentado entre eles cinco ações judiciais contra mim e minha esposa - isso em um período de três anos. Eu poderia assinalar que no mesmo período de tempo o número de processos que entraram contra sua família alargada, ou qualquer outra pessoa no Brasil é zero. Sim, isso é certo, ZERO!

Espero que este senhor esteja errado. Mas ele certamente tem algum conhecimento desde que ele é um brasileiro que vive no exterior. Meu palpite é que ele viveu nos EUA por algum tempo, já que a expressão ''Jack-squat'' é muito americana. No entanto, desde que eu não sou um brasileiro, mas sim um hóspede em seu país, vou abster-me de comentários negativos sobre os políticos aqui. Enfim, como gostaria de dizer, após ser desviado por um comentário de um cidadão brasileiro, gostaria de convidar o Sr. a vir conhecer a mim e minha esposa em nossa casa que é mantida refém no Estaleiro RENAMAN. Eu ficaria feliz em mostrar-lhe fotos do veleiro como estava quando foi trazido para o Estaleiro RENAMAN, e o Sr. pode comparar as fotos do veleiro como está hoje: quase destruído pela ganância e vingança total do cunhado de seu cunhado, que odeia estrangeiros com paixão e não sabe nada, absolutamente nada, do que é um grande navio a vela. Ele não entende que este veleiro tem uma alma e um espírito MUITO FORTE, que irá assombrá-lo pelos restos de seus dias. Ele teve uma chance de fazer a coisa certa e ser amado na parte do céu que é reservado para grandes marinheiros e seus navios. Mas, infelizmente, ele falhou.

Sr. Evandro, faça a você mesmo e sua família próxima um favor, não se deixe ser sugado para dentro do abismo do cunhado do seu cunhado. Venha nos conhecer, converse conosco. Se o Sr. está interessado em tais coisas, podemos ter alguns membros da imprensa nacional lá. Mas acima de tudo, por favor me assegure que você fará a coisa certa para a comunidade de Mangaratiba, tratar as pessoas em sua comunidade como você gostaria de ser tratado sempre que visitar outra comunidade. We are a retired Californian couple held for ransom by a Brazilian crook who has detained our sailing yacht in his boatyard for over 3 years. The Brazilian Lower Court ruled against his false claim for damages. The Apellate Court unanimously negated his appeal. Legal procedures are exhausted. He refuses to launch our boat, which is our home. The American Consulate in Rio Janeiro told us they willnot intervene. We have sent letters to Hillary Clinton, Ambassador Shannon and our senators one year ago with no response.

Because the barbaric tragedy which overcame our fellow sailors (S/V Quest) in the Indian Ocean has disturbingly emphasized the increasing issue of safety of Americans traveling abroad, we are urgently requesting US governmental assistance in terms of applying pressure to Brazil to force this crook to set our vessel free, thereby us personally. LORD JIM is a US Coast Guard documented historic gaffrigged topmast 85foot schooner. We read that President Obama is coming to Rio Janeiro March 20th. Could he please bring our critical situation to the attention of Governor of State of Rio Janeiro, Sergio Cabral. We are in Mangaratiba only 60miles from Rio.

My goodness !!! A couple of years ago I read a brief account of your problem in Lat. 38. Not being an afficianado of the internet, though, I assumed your difficulties had been resolved and you, Lord Jim, & all concerned had been "made whole" and were continuing w/usual adventures. My most sincere sympathy to you & yours, Tracy, I doubt there's anything I could do to help, but E-mail me if anything comes to mind.
