The LATimes had a short piece on the lowering of legal age (of responsibility) in Brasil from 18 to 16 years old. I have tried to find out whether the change is (1) proposed (2)passed (3) in effect now. Since minors maim and kill each other regularly in my barrio -- and are back on the street within days, I am curious whether they will be treated as adults at 16 and there will be consequences for the daily mayhem. As well, does the lowering of "independence" also mean that the age of sexual consent will be 16 years old. If anybody has any info on this, I would appreciate knowing -- or if there is a website (I've already tried InfoBrasil) I could access, let me know.... Thanks!!

The new civil, not criminal code, is in force for a few weeks now. As far as I know nothing has changed in the age a person can be prosecuted as an adult. Civil maioridade was reduced from 21 to 18 years of age so that a 18 year old or even an emancipated 16 year old can sign contracts, open a company or marry. Until there is a new criminal code, youngsters younger than 18 are considered minors. There is a push to reduce this to 16, but such change could take a generation to be approved.
