The Brazilian Air Force determined that the left wing's tip of the smaller plane, the Legacy, cut off a piece of the Boeing's right wing making it fall in a spiral into the jungle from a height of 37,000 feet, or about 11,270 meters.

1) if it is fair to seize the passports of the US pilots, it should be just as fair to seize the Brazilian ATC passports....as no one knows yet for sure who commited an error. And accusing one side, defending the other (guess what side) is INJUSTICE.
2) The reporter doesnt seem to be aware that the Brazilian investigators (not foreigners) have a different view than the reporters, if David Lerer, would read both the Brazilian and Foreign News.
3) It is quite funny that the reporter accuses the US as arrogant, when from day one, it was ALL the Brazilian press and ALL the Brazilians government who accused openly the US pilots.......before the end of the investigations. If that is NOT INJUSTICE what is it.
4) Below is an article excerpt from a Brazilian reporter (not foreigner) in Sao Paulo, showing that the Brazilians ATC and (IN)justice have rather a strange attitude. Of course the same excuse would have not been accepted if the US pilots did the same.Guess why !

"Oct. 30 -- Ten Brazilian air traffic controllers scheduled to testify this week about the crash of a Boeing 737 in the Sept. 29 Amazon crash that killed 154 people, said they were sick and would be unavailable to investigators.

The air controllers, all based in Brasilia, sent statements to the federal police saying they were ill and would be unable to testify, said a federal police spokesman in Sao Paulo."

Funny...isnt it ? Did they all get a diarrhea......at the same time ????????

Brazil is really nothing else than a Tropical mud and a Tropical mess !

As a former House representative in Brazil, how much did you cash in illegally through corruptions and in how many corruptions cases have you been involved officially and unofficially ? David how much is worth your undeclared condo in the USA ?
As you know it is due to people like you, the Brazilian politicians, that your country is such a mess and has so much poverty.
You stole everything for yourself and your peers, leaving the residues (not much) to the majority of the population.
You probably find quite normal to export US$ 50 billion annually of agricultural products, instead of feeding FIRST your tens of millions of under nourrished citizens and the millions in hunger ! Greaaaatttt........truly greaaat !

It will be a greater tragedy if innocent people are sent to prison, while those reasponsible remain free. It's easy to pull on people's heart strings in order to get them to take your side, but do you think Brasil is the only country to have tragedy. If i remeber right 5 years ago 4 planes crashed on the same day in the United States and we couldn't bring the ones who did it to justice. But there was one guy who didn't have the stomach to pull it off, but was in all the planning. This man's trial went on for years just so the US could be comfortable with dealing out fair justice. My point is that the vast majority of Americans would agree that if these pilots were reasponsible for that crash they should be met by the entire wait of the Brasilian justice system. Yet, it is a possibility that it wasn't their error. This is why judgement should be held until a full investigation is completed. As far as how much money they are spending on there defense, well that's a fact of life that happens in every country, especially in the US. What we've noticed in the US is that most of the time it doesn't matter how much money you have, if you are guilty you go to jail. I'm sure that the pilots would probably try and buy there way out of this mess, anybody would. I'm also sure that the second thing there trying to buy is a fair trial, which is understandable. It wouldn't be the first time that a foriegner was railroaded by a kangaroo court. As far as being undressed at the airport he can be mad all he wants, but he's not the only one getting undressed. Every fifth person does because it's not legal in the US to only make young middle eastern men go through it, that would be racial profiling, so everyone goes through it. And the comment about Gautanamo Bay was ridiculous you Brasileiros watch way to much CNN international and there misrepresentations are starting to lay roost in your brains.

For you lovers of the Brazilian ATC system, just have a read in the news of the current Air Traffic problems in Brazil, take a trip to the Airport and stand in line.

This is just more of the rhetorical diatribe that losers use to justify their impotent, lack of self esteem, inferiority complex and to shift the blame from their own corruption to the attention of a mythical adversary.

The U.S. is not Brazil's enemy, Brazil is their own enemy.

A decent education Brazilian can stand face to face with an American or anyone of any nationality with pride and negotiate competent business or international affairs. As for the rest they are intimidated neurotic losers, like Chavez who wait in line in hopes of somehow belittling the BIG GOLIATH.

Sorry but Embraer produced 155 planes in 2004, 145 in 2005, and recently reduced their 2006 production estimates from 145 to 135 !!!!
That is not selling as cakes do....in my view !
Just check Embraer site, by yourself, to double check what I am saying !

Furthermore, sorry that reporters such as Lerer are so stupid and totally ignorants, because if they think for 1 minute only, the would find out that the vast majority of Gol planes are not Embraer, but Boeings plane !
I can only suppose that Gol management knows why they have chosen a foreign made and not a Brazilian plane !

Finally, you could be proud as you were that Embraer recently got a US$ 1 billion (plus the eventual options) order from Northwest Airlines. Your ego made that this news was on every single Brazilian and foreign newspapers ! But you have hidden the fact, on purpose of course, that Northwest Airlines is operating under Chapter 11 of the US BANKRUPTCY LAW and that by definition their financial status is more than quite precarious !!!!!

No doubt that Varig, your own airline is willing to to give such an order too ! Laugh !

What are your qualifications? Enjoyment of ranting? stop exploiting a tragedy so you can act superior. It is a tragedy for everyone. What we need is changes in air traffic control and other regulations and policies so this never happens again -- worldwide. Not arrogant ranting and blaming. There is plenty of blame to go around to Brazilians as well as Americans. So take a deep breath, pull the stick out that's implanted in your butt and get over it.

BRASILIA, Brazil - More than 150 Brazilians were murdered each day last year on average, putting Brazil on a par with some war zones in terms of its homicide rate, the Justice Ministry said today.

Some 55,000 Brazilians died of homicide in 2005 - a few thousand more civilians than in three years of war in Iraq, according to leading estimates.

Brazil, a continent-sized nation of 185 million people starkly divided into rich and poor, has had notoriously high crime rates for years. Millions of poor live in urban slums and unpoliced rural areas where guns are easy to come by.

Though the murder rate is high, Marcelo Durante, co-ordinator of the Justice Ministry's report, said homicides have fallen slowly in recent years thanks in part to an initiative to collect guns from the streets.

Citizens have voluntarily turned in thousands of weapons in places like Rio de Janeiro, the famous beachside city whose urban slums have some of the highest crime rates in Brazil.

A referendum in 2005 to ban gun sales failed, in part because some voters had lost faith in police.

"It was the states that collected the most guns that saw crime rates fall most," said Durante, "but we have to remember it's not just about guns."

Other kinds of violent crime in Brazil are far more common than statistics show, Durante said, adding that urban surveys suggest only a quarter of all robberies and 15 per cent of all rapes are reported nationwide.

"At least with homicide, we can be a little more confident most of the crimes are getting reported," he said.

Murders also declined in Brazil's largest city of Sao Paulo in recent years, Durante said. Earlier this year, however, a gang known as First Command of the Capital launched a series of attacks on police, banks and buses in which about 200 police, gangsters and innocent civilians were killed.

As we can read above, a stupid Brazilian wrote an stupid article and several American citizens reacted as stupid cowboys, revealing their prejudice against the entire Brazilian population.

Reality is: (1) the accident was caused by a sequence of small mistakes, part of them incurred by Brazilian air traffic controls, part of them by the American pilots. (2) The American pilots are not in jail. They are free to go everywhere, doing everything they want. They are not allowed to leave the country because they are the only survivors who can help clarify the causes of such accident. This is the same procedure the American Justice apply to any possible offender before his/her guilt is proved (or not) (3) The Brazilian press was clearly partial in this case, judging the Americans based on weak evidences and preliminary conclusions. Today the press has been forced by facts to accept that the air traffic controllers had an important role in this tragedy (4) Embraer is a major player in the aircraft manufacturing industry and it´s growing. Production is not smaller today than in the past. Embraer is shifting from small size plane manufacturer to large size plane manufacturer. And takes longer to craft a 100 seat airplane than a 29 seat one. (5) Corruption is widespread among politicians. It is a cancer in our society. (6) "Statistics" broadcasted worldwide about poverty in Brazil are largely false and not supported by serious demographic research. Those who have no income from jobs get a cash from the government to buy food. People die from diseases, urban violence, car crashes but not from lack of food.(7) American imperialism is an old fashion leftist expression that the current leftist government love to apply to everything (smilies/cool.gif Brazilian companies by airplanes from Boeing. Everyone should slow down a little on this very sad accident.
The facts will come out, it may take a long time, but they will come out as the Brazilian newspapers are very good.
Just today in Brazil all air traffic has been brought to an almost stand still...
Why? the air traffice controllers have started a "strike" to demonstrate their overload - and maybe to prepare the country for their mistake due to their overload....
It is very strange that all ten controllers due to testify called in sick...also that they have not made public their voice recordings with both flights.
Over a month ago this accident happened and these radio recordings have not been made public yet.
I hope that these radio recordings do not become lost or deleted........

Nicely said Fabio,

Funnily enough, what annoyed me most about the original article was the bit about depressurisation and lack of oxygen. Not really sure that that would have happened, as with the aircraft's descent the oxygen levels would have been steadily rising after a possible inital fall (if the fuselage was ruptured at all).

Anyway - does this have to get so personal? I'm not sure why there are comments about the Brits here, they've got nothing to do with it. I don't think the US pilots should be allowed to leave until the case is cleared up. I don''t think their detention in Brazil is any worse than the Patriot Act is it? I also live in São Paulo and am aware of the many problems in Brazil, (Professor - if you're a Yankee living in SP and have so much to complain about - why not go home?) but I have also lived in the US and it has certainly got plenty that the rest of the world can complain about. A tendency for going to war unilaterally; a disregard for the global effects of its enormous emissions (do they really believe there's no evidence for global warming?) - just look how much everyone complains when fuel prices go up, even though they're still so much less than elsewhere; a population that is generally ignorant about the outside world (you're lucky to get news from beyond your state, let alone another country, and even then it's only in the cases in which the US has a vested interest; hey - they elected Bush for a second term, and this time he won democratically. This article is poorly written, but inadvertantly points out one of the main issues being discussed in the English language professional airline pilots´blogs: how did a commuter airplane´s winglet bring down a 737? No one can explain it. Some have suggested that more emphasis should be placed on training pilots in unusual attitudes, i.e., an intro to aerobatics and more emphasis on spin recovery. This accident is a conundrum.

As a part of the Brazilian aviation community, with pilot and mechanic certificates both in the US and Brazil, and thousands of hours, let me add that aviation professionals themselves do not usually get drawn into country versus country discussions, but tend to view the aviation community as a unit, as contrasted with the non-flying public. In Egypt it was the government that continued to deny that an airliner copilot purposely brought down a flight in order to commit sucide. An Egyptian aviation expert told the truth and has not been heard from since. The truth did not fit in to their concept of national honor.But aviation professionals want the truth so they can learn from the mistakes of others.

So much baloney has been published regarding transponders. Radar has been around since the 1940´s. Radar can identify the location of an aircraft (or a weather balloon) whether the object has a transponder or not. In the past few years another function was added to radar stations, which added the basic transponder, allowing the controller to assign a four digit code to the aircraft for futher ID purposes. Now they can see you AND know who you are. Mode C adds another function, an altitude readout. But the radar station can still see (paint) a plane with no transponder. And yet you have people writing for major media who evidently have the idea that if a plane has no transponder turned on, the controllers can´t see him . Wrong. But so sure of themselves.

indeed, this article is poorly written. Lerer is sounding off on the same nationalistic bulls**t that got the U.S. into Iraq. Let's hope Brazil doesn't invade Paraguay... oops, I forgot. They're friends going back to the Operation Condor days (Alfredo Stroessner? hello?)... not even Lula can clean up that mess. Back to the story at hand, there was a plane crash here. And every day that passes is another day that the families of the victims will not know what happened. And like every other plane crash that occurs, if officials, pilots and the airlines don't learn why the accidents happen, they can't prevent the same mistakes from happening again. If Brazilian officials are holding the air traffic controllers for 'psychiatric evaluation' then something is very very wrong with the oversight of the Brazilian airline industry. This accident was a real tradgedy, but why is everyone assuming that the GOL pilots were completely blameless? As has been stated above, it's amazing that the the Legacy managed to bring down the 737 considering the relatively minor damage to the Legacy. We still don't know what the GOL pilots were doing when the accident occurred.

Why doesn't everyone back off the heated rhetoric, and wait for the results of the investigation? I just hope that all of the truth comes out, and let the blame fall where it may.

I am an citizen of the United States of America and I'm proud of it and I would expect any Brasiliero to be proud of their citizenship as well. This crash was a disaster for all humanity and contrary to what some apparently believe, no one in the U.S. or Brasil wanted this to happen. This is not about "American Imperialism" or "Brazilian incompetence". Mistakes were made on both sides and the only proper course of action to follow now is to find out the truth and take corrective action.

Shame on all of you who have written such hateful comments...Americans or Brazilians. None of your comments do anything to comfort the families who have lost dear loved ones. Instead of wasting your time writing hateful comments, we should all be trying to discover ways we can learn from each other instead of insulting each other.

I'm hosting a young foreign exchange student from Brasil in my home right now and I thank God she doesn't have to read some of the garbage both sides of this issue have put out on these pages.

I will pray for all of the families who have lost loved ones in this tragedy and that my friends is far more constructive than most of your comments here......Good Bye.

P.S. I would dearly love to visit Brasil someday, but I really can't say I'd feel welcomed there after some of your comments. You failed to put in context the responses of the US officials and company representatives, who are responding to a media linching of the two pilots.
It is worth noticing that under ICAO rules judiciary should have waited until the end of the investigation. Instead, responding to the media storm, judges and prosecutors got their 15 minutes of fame by taking the passports of the pilots away.

Furthermore, in your charges that the US is blaming Embraer by pointing to a possible failure of the transponder, you are underscoring your own ignorance about the situation: the transponder is made by a US company.
In summary, if people like you would be quiet and let the technical investigators find the CAUSES of this tragic disaster, things would be better for all.

This is not a political incident, and idiots like you are trying desperately to make it into one. This is an ACCIDENT, and if there are entities or people that are found negligent, the rules are clear on how to proceed.

David Lerer is a historic political and intellectual figure in Brazil. He was an active member of the left wing party, more exactly an icon of the democracy cause, during the dictarorship ( he exilated himself not to be killed...) and rest his case after redemocratization.

Both Brazil and the United States are great countries.
This aviation accident was a terrible tragedy.
As a US citizen, I believe the pilots of the US plane should have the passports held until a full investigation is completed. This would be considered normal and acceptable to both parties.
Should it be found that the American pilots were at fault, they should be tried in a court of law.
I wasn’t there, so I do not know the facts. What I do know is that this was a really sad event and I wish it had never happened. My heart goes out to the families who lost loved ones. My prayers go out to them as well. I am so sorry for their loss.
Whatever the US can do morally and financially to ease this situation should be done.
The United States and Brazil should remain good friends and work to assure that this type of accident risk is reduced in the future.
Again, God bless all of the people who have been affected by this tragedy.

I have read attack after emotional unsound attack in these threads from pseudo nationalists that think all truth comes down to the arrogance of America. And while it may be true in many instances, truly today we can see clearly who the arrogant ones really are.
In the future before jumping to your slanted, hateful conclusions, realize that the people that were involved in this tragedy were all human beings not just Brazilians. If Brazil insists on having a hate speech law, Americans visiting Brazil should utilize it and demand justice when hate speech is directed at them. I hope this begins with the US pilots. It looks like most of us who were blaming the Legacy pilots just commited a stupid mistake what demands thus that we apologize.
The Legacy pilots did nothing wrong, they were just following the instructions. First of all, we are so full of pride and we've been told lies about the greatness of our nation that we end up acting just like the "arrogant americans" we criticize, when after all, the fact that the US leads the world economy cannot be discussed ( we tend to make critics to people in US who are proud of being American but we are proud of bein Brazilian, aren't we?) and they mantain a mature and solid society.

God, I am not sure why I was so stupid to trust the flow and had the stupid reaction to blame the American pilots. Why did I repeat stupid? Because, I can admit I was stupid and must apologize. You guys and girls should follow me for the sake of the honor of the two pilots.

CHARLESTON- Yeager Airport's air traffic controllers say delays are inevitable for the upcoming holiday travel season, regardless of any weather problems.

Air traffic controllers say the delay is a safety issue that is directly caused by the Federal Aviation Administration.

"You're dealing with the lives of many people," said Jim Ennis, a local representative with the National Air Traffic Controllers Association.

Whatever goes up and comes down is in the hands of 22 air traffic controllers at Yeager Airport, including David Large's life.

"Once you're in the sky you're hoping okay, everything is good," said Large prior to his Tuesday-morning flight to Nashville," You don't want someone falling asleep at air traffic control."

In January, there may be controllers working overtime as the staffing level will fall to 19.

While millions of dollars beefed up passenger screening, Ennis contends that the FAA has been cutting back on safety once plans are in the air.

Across the country, the number of air controllers has declined.

"You have good men and women who work here at Charleston airport and nationwide," Ennis said. "When we start seeing safety compromised what you'll see is, we'll start curtailing services which you then you have delays."

The 'do more with less' mentality not only applies only to manpower, but to technology as well. The radar in use was developed in World War II. The upgrade that was supposed to take place at Yeager in 2007, but has that probably won’t happen, said airport director Rick Atkinson.

"Its not benign neglect in my opinion," said Atkinson. "Its negligent neglect of the system. If that continues there will be a real problem."

A spokesperson for the FAA says Yeager can be safely staffed with 20 controllers. Large says he has faith in the system, while Ennis says this is a crisis.

Air traffic controllers must go through two years of on-the-job training prior to working on their own.

Ennis says the FAA has not hired an adequate number of controllers to replace those who are becoming eligible for retirement.

WASHINGTON -- More than half of U.S. commercial airports don't have a 1,000-foot margin at the end of a runway, an overrun area the federal government says is needed as a safety zone, according to a new report.

Some of the busiest airports in the country - including Boston's Logan International Airport, Los Angeles International Airport, Chicago's O'Hare International Airport and Hartsfield-Jackson Atlanta International Airport - have more than one runway that doesn't meet safety standards, according to statistics supplied by the Federal Aviation Administration.

"Our runways are out of shape, and the Bush administration has failed to move to correct the problem," Sen. Frank Lautenberg, a New Jersey Democrat, said Thursday. "If we don't get serious about runway problems, the result could be disastrous."

The FAA says it is diligently upgrading the runways. The agency expects that all of them will meet the standard by 2015, when they are legally required to do so, according to FAA spokeswoman Laura Brown.

"Today, 70 percent of commercial service runways have a runway safety area within 90 percent of the standard," Brown said. She said 236 runways were improved as of Sept. 22.

At 325 airports - more than half of the 573 commercial airports in the United States - at least one runway lacks the 1,000-foot safety zone, according to the FAA's own figures. Almost half of all commercial runways - 507 of 1,017 - don't meet the safety standard.

Logan has five runways, on which planes land in both directions, meaning there are 10 "runway ends." Half of those do not meet the 1,000-foot safety zone, according to the FAA and Logan officials. Logan has built "arresting systems" and safety ramps at the other five runway ends, said Richard Walsh, spokesman for Massport, the agency that operates Logan.

"All major runway ends at Boston Logan are in conformance with FAA regulations," Walsh said.

Logan is the nation's 17th busiest airport and is located on a mostly man-made peninsula jutting into Boston Harbor, with five intersecting runways. A sixth runway now under construction will not cross the other runways, Walsh said.

Deadly airplane crashes can happen on runways because they're too short, improperly lit, poorly designed or lack safety equipment. A minor procedural error by a pilot or an air traffic controller can turn tragic if a vehicle or another airplane happens to be in the way.

Federal safety investigators are looking into three runway mishaps this week alone: An Alaska Airlines jet landed on the wrong runway at Seattle-Tacoma International Airport; two airliners clipped wings while taxiing at Newark Liberty International Airport; and another jet landed on a taxiway at Newark.

Within the past year, two fatal commercial airline crashes involved runways.

In August, 49 people were killed when a Comair regional jet took off on the wrong runway at Lexington Blue Grass Airport in Kentucky.

And in December, a 6-year-old boy in a car was killed when a Southwest Airlines 737 overran a runway at Chicago's Midway Airport and plowed into the street.

Part of the problem is that airports were built in congested urban areas and have no room to lengthen their runways.

One solution is to install soft concrete beds at the end of a runway. Called Engineered Material Arresting Systems, or EMAS, they slow an airplane that rolls off the end of a runway.

Last month, a private jet carrying Yankees third baseman Alex Rodriguez overran a runway at Bob Hope Airport in Burbank, Calif., and was brought to a halt by an EMAS bed.

BURLINGTON, Vt. -- A private plane crash that killed the pilot last year as he approached the Burlington International Airport was most likely caused by pilot error and inattentive air traffic control, said a report by the National Transportation Safety Board.

The report said pilot Donald Roberge, 49, of Ellington, Conn., did not stay within the defined instrument landing approach path into the airport on Nov. 22 last year.

And air traffic control officials at the airport didn't see or hear a low-flight alarm in time to warn Roberge that he needed to gain elevation before he crashed into a wooded and hilly section of Williston, the report said.

No problems were found with the plane, the report said.

Roberge, who had flown from the Hartford-Brainard Airport, was alone in the twin-engine Piper Aztec as he approached the Burlington airport and told controllers he would land using his instruments. The plane crashed about four minutes after it was cleared to land, the report said.

"The local controller's first instruction to the pilot to 'climb' was five seconds after the last target was observed on the radar," the report said.

The report said an unnamed air traffic controller failed to see or hear a low-altitude warning.

Union representative Steve Walsh said two controllers did not recall hearing the alarm, but investigators who reviewed the radar said they saw a low-altitude alert for the plane.

But Walsh, an air traffic controller and local union representative for the National Air Traffic Controllers Association, said monitoring the radar screen was not the primary duty of the controller singled out in the report.

"The tower controller is not duty-bound to watch the radar scope. His job is to scan the airport surface and airport environment using the control tower windows. Had there been an alarm, there was a supervisor there," said Walsh. "The audio alarm is the part that would then warrant the controller to look at the display. He didn't get an alarm."

The Federal Aviation Administration is investigating why an air traffic controller responsible for directing planes in the Charleston, SC area fell asleep on the job early one morning last month.

FAA spokeswoman Kathleen Bergen says the unidentified employee was found asleep in the control tower of Charleston International Airport about 6:00am on September 13, by a co-worker arriving for the next shift.

"He allegedly dozed off for a few minutes," Bergen told The Associated Press. "We're looking into the circumstances surrounding the allegations that someone was sleeping on duty."

According to media reports, no flights were affected by the dozing controller... although five commercial flights were set to take off in the next half-hour. The controller in question was also responsible for handling all traffic within the Class C airspace surrounding the airport... and planes flying in and out of four other airports in the area.

Doctors have since cleared the employee to return to work. Bergen would not comment on whether the person was penalized.

A spokesman for the National Air Traffic Controllers Association -- union for the approximately 14,200 air traffic controllers nationwide -- said he's not necessarily surprised that a controller was found napping -- as most airport towers are understaffed, and controllers have to work six day work weeks to fill in the gaps.

"This is a tired work force, no doubt about it," said Doug Church. "There are fewer controllers handling more traffic than ever before."

The comments of Mr. Joe Sharkey about this tragic accident made me think about the mentality witch founds a disrespectful and unequal relationship between rich and poor countries.

In multiple incidents everywhere the way how people think is crucial to determine if one incident will escalade to peace or to war. And I believe it is about time to review some concepts, concerning the last dangerous global events that all good citizens are facing around the world.

I was quiet and sad following the news over this tragedy into I saw Sharkey’s interview. And as a reaction (it’s always how it begins…) I have to say:

Americans live in a very controlled pseudo-democracy. One of your favorite slogans is: “Let’s make war abroad to keep freedom in America”. But what kind of freedom do you have at the present days?

For example, when you go party, if you drink one beer, just one beer, the chance that you go to jail in your way back home facing a DWI is huge. If you are a smoker and want to enjoy a cigarette in a pub, you have to abandon your beer alone inside and go out to have a smoke alone. What’s the fun in that? If you say something nice to a girl, she may suit you for sexual harassment. And if you are over 50 years old and single, your chance to get nice sex for free is almost zero. One exception is if you are a college teacher.

Well.

When you cross borders to any place down Texas you behave yourselves as Pirates, disrespecting all possible laws that you obey in the USA.

I do remember a terrible car accident occurred few years ago at Copacabana Beach involving some Navy Americans. Five young Brazilian girls where killed. The result of the Investigation was that the Navy boys where all drunk and crashed at a speed over 110 miles. Somehow the American embassy got involved and, once again, the killers didn’t face charges.

Besides that, daily incidents happen in Rio and around Brazil involving Americans with pathetic behaviors, mostly related to drugs abuse and basic rules of education, eventually pedophilia and prostitution.

Considering this, it wouldn’t be a very surrealistic picture for Brazilian citizens to imagine that the occupants of the Legacy where, as usual, repeating this "Pirate-behavior-mentality" during their flight:

The pilots may turned off the transponder and say: “Let’s see what this Brazilian babe (airplane from Embraer) can handle!” and started to do some crazy maneuvers. At the same time - pushing just a little bit to complete the stereotype - back in the cabin a party was taking place with some nice young Brazilian girls (or boys), cowboy whiskey, caipirinha and God knows what else…

If there were no traffic at the Brazilian air space, the Legacy would land at Mato Grosso as planed for a scale, the girls (or boys) would step out the plane and his passengers would normally flight back to the USA. By the time they flight over the Tex-Mex border everybody would be recovered from the party and ready to reassume their respectful social selves.

And when they arrive home, they would probably give a big hug in their kids, walk the dog, kiss their wife, and say: “Honey, I miss you so much!”

But not every story has a happy end. In this one 154 people died and two pilots may probably face serious charges. Anyway, if they have to spend some time in jail here, you don’t need to worry that much, because we give better treatments to our prisoners in Brazil than you do at Guantanamo Bay.

Even more desolating is a journalist writing tendentiously, increasing the gap between America and the rest of the world.

Brazilians and Americans are good people, but as you see, it’s so easy to loose it in stupid stereotypes. At the end I sincerely believe that we are al humans trying to be happy in a complicate planet, in a complicate time.

The United States is the worlds most multicultural country (at least said to be). Understanding multicultural to mean distinct virtual ethnic tribal neighborhoods living within one nation state - understanding a nation state being an entity that requires clearly defined boarders. Accepting the term multiculturalism in this way however does not negate the diversity of another nation state say in example Brazil. Brazil could arguably be less multicultural (using the term in the sense I gave) than the United States but more diverse and accomplished in assimilating various peoples into one Brazilian culture. Both cultural phenomenons can have their strengths and weaknesses. It would be overboard though to proclaim the United States "the world." What is real is real in its consequences - assuming this so - then considering the share of the world collective GDP that the United States owns the United States is anything but the world.

But Mark your story is not what happened on the Embrare and we all know that. I think you were making a hypothetical situation there right? How would you feel if you were in the US and were accused of somthing that absolutely did not happen but speculation had the entire country wanting your blood. It would be a scary life altering experience. These poor guys are a victim of the United States rep**ation and they have the US government to thank in a round about way. Most of my Brazilian friends in the US that I have asked about this situation are getting their information from their relatives in Brazil. They are thinking at this point that it is ATC, AND the Pilots at the wrong altitude with not following thier flight plan. But no one knows what the standard operating procedure is when you lose communication. What the tower tells you to do trumps your flight plan. and its up to ATC to move other aircraft out of the path of the plane without communication. So Brazil can cling to "the pilots should have followed their flight plan, but in the end, the standard operating procedure that is adheared to all over the globe by pilots is going to stand on its own and be a huge lesson to Brazils ATC. I think that has already happened. But on a last note, I am still interested in hearing why the transponder wasn't working. That still seems to be an outstanding question. I assume it is the same problem as communication loss, but we all see what can happen when we assume...
Joe Sharkey, if you are reading this, it might be at least a little good do some apologizing. Go through your blog and apologize for some of the things you could have said better or not at all. I am from the North East coast of the US. I know how verbally aggressive people from this part of the US can be (NY, PHILA), but in a situation like this, its wholly inappropriate. According to brazzil.com it is perfectly fair that the two pilots have been held for well over a month now whilst enquiries are being carried out. How is this perfectly fair? Two normal respectable Americans are being held away from their families. Surely they should be allowed to return home until proper substantial evidence is gathered, then they can be brought back to Brazil.

Two planes collide in Brasil, 154 passengers die, two pilots are held pending investigation, being ruthlessly demonized by officials and the media while the investigation is continually botched and delayed without much explanation...with reports of air traffic controllers being the real culprits for the disaster. Pilots are still stuck in Brasil and under suspicion for nefarious activities theorized by government officials, the brazilian media and its excitable lynchmob-like readers and listeners.

Meanwhile, various brazilians (among others) employ their best use of politized English go on an internet campaign, in an endless tirade of pissing and moaning their lot on life, through the use of defamatory language - accusations, half-truths and stereotypes tainted with paranoia and at best

Yes Brazil has made alot of mistakes in this investigation and situation in general. I don't think that should be excused. The lunacy of thier accusations is obvious. But we can't sit back as Americans and say we never make mistakes and we can't sit back and say were perfect! We have a bad rep**ation in the world. Can we face that for a minute here? Maybe try to understand the hate coming at us? And these pilots? Americans are known for visiting other countries and not behaving themselves as they should. hey. Im fourteen and im reading this article for my world history class. Personally, I'm shocked. How can people be so heartless? We're talking about the lives of 154 innocent people and here we are fighting about how arrogant the United states is. I know that it's not the greatest country in the world, but is Brazil? I'm thankful for what I have. I'm not starving or living in the streets, but I'm not livin' it up in a Malibu beach house. Our country may be fabricated into "the heartless americans who just care about themselves", but theres still people here who care. I'm writing this in the memory of those who lost their lives, and for their familys. I'm very sorry. No matter who's fault it was, nothing can bring those people back. Show some heart people. It's not about who is the selfish arrogant country. Stop the name calling and be mature. There was 1 American on the Gol flight. He was from Missouri and living in Brazil. Gearheart, I am a Yankee (Gringa now living in California) making a comment about Yankees (people can be verbally aggressive in the North East coast of the US). I am not from Brazil, I grew up in Philadelphia (my family is old Philadelphia, Pennsylvania Quakers), and I also lived in Florida for a time (Southern US). It's articles like this that confirm not only many brazilians hatred and jealousy of the U.S. but also the ignorance that exists in Brazil. I think it's fair to say that this was an ACCIDENT. I don't know of any pilot that would purposefully want to crash into another plane and kill themselves and everyone involved, unless you are a terrorist, which plainly all pilots involved were not.

It is discouraging although after this accident when you see brazilians interviewed on tv and they make statements such as "if it was a brazilian he would be labeled a terrorist, blah, blah, blah".

Now that the reports have been concluded, by BRAZILIANS, and concluded there was no ERROR by anyone, what now?? An apology from those that jumped to conclusions before even doing an investigation?? It's as easy getting an apology and admission of a mistake by a Brazilian as it is finding a home that's not surrounded by 15 foot walls and electrical fences with glass sticking out of the top in Brazil.

The pilot has final authority. That is how the two Yanks landed without direction. I don't for a minute think they are guilty of any crime, or of violating flight rules. Now if the controler said fly at 36000 and the pilots flew at 37000, the pilots would be wrong. Everything I've read to date says the us pilots acted properly. "Dark"territory exists in many parts of the world, the rules are the same for all of those areas: do what the controller told you to do, he has a bigger picture available than any one pilot. I would just like to say that it truly makes me sick to see brazilians and americans arguing and being so petty. I am an american and have a brazilian wife. We have a house and farm in Kentucky and another house and farm in Rio Grande do Sul. Therefore, as anyone can see, I have deep ties to both countries. Therefore, I am not biased.

Some people have been going on about the air tragedy and trying to turn it into an american "imperialist" conspiracy, just as they try and do with many other issues. Well, we all know what these people are. They are just Petist, MST loving, lazy-ass quasi-socialist bums that want something for nothing. The reason I know this is because I know Brasil and all of the various regional mentalities throughout the country. I bet you that the "doctor" is a PT-loving Nordestino that is attached to Lula's bum.

Granted that many americans are somewhat arrogant, we are still moral people with good values. We work hard for everything that we receive. On the other hand, you have people like the "doctor", who used to be a respectable dep**ado (hehehehe- it doesn't exist) that want to bash us simply because of the fact that we have historically been more fortunate than certain other people throughout the world. We can't help it, it just happened because we worked hard.

Ok, enough mud slinging. There are good thing and bad things to say about any society or nation. I'll try to explain this from a "neutral" point of view.
1) Irrigarless of what nationality of plain or passengers the fact is that two airplanes collided in mid air.
2) Even though most peole see the sky as an open ocean of air it's not. There are air traffic corridors just like a freeway in the sky. Commercial airplanes fly along these routes.
3) It's the pilots responsability to say on course as their assigned altitudes.
4) It's the pilots responsability for maintain a visual watch for other aircraft even if they are flying IFR.
5) The altitude an airplane must maintain is dictated in flight regulations and determined by the direction the airplane is flying.
6) Airplanes flying IFR tracking 000º to 179º must maintain flight in odd thousands of feet (25000, 27000, 29000, etc) note they are seperated by 2000ft intervals.
7 Airplanes flying IFR tracking 180º to 359º must maintain flight in even thousands of feet (25000, 28000, 30000, etc) note again the 2000ft intervals.

That means the Boeing 737-800, traveling from Manaus to Brasilia was on an easterly course between 000º and 179º and should have been flying in odd thousands of feet.(35000, 37000, 39000)
It also means the Legacy was traveling on a westerly course between 180º and 359º should have been flying in even thousands of feet (34000, 36000, 38000)
If they both were on course and maintaining the correct altitudes the collision would never have happened.

The collision happened at 37000ft which was correct for the Boeing.

If the Legacy had clearance to fly at 37000 feet it would be an error on the controllers part and should have been questioned by one or both of the Legacy pilots and never been flown.

Both planes were equiped with collision warning systems yet neither had them activated. Why?

Neither plane had contact with a control tower. Why?

Neither plane made visual contact. Why?

Any way you look at it the american pilots were at fault, even if the controller was at fault for clearing them to fly at that altitude and should be prosecuted. (yes, the controller should be prosecuted also)
