Brazil's Supreme Court José Luis de Oliveira Lima, the defense lawyer for José Dirceu, the former presidential Chief of Staff, a cabinet-level position, declared that his client did not know of the existence of vote buying or details of the administration of the PT while he held office in the Luiz Inácio Lula da Silva government.

Specifically, Oliveira Lima refuted the charge that Dirceu was the mentor of the mensalão scheme. He made a point of emphasizing that Dirceu was innocent not because the prosecution's case was weak, but because the mensalão scheme did not exist.

Oliveira Lima went on to admit that Dirceu wielded enormous influence in the government, as the prosecution charged, but he pointed out that having influence was not a crime.

The defense lawyer said that although Dirceu had long been an important member of the PT that changed when he took over the Casa Civil. According to Oliveira Lima, Dirceu stopped active participation in the affairs of the party when he took an important post in the administration.

One tactic used by Oliveira Lima was to attack Dirceu's accusers. He called former deputy Roberto Jefferson, the mensalão whistleblower, as "an eloquent speaker who is good at acting."

Lesser Crime

The Brazilian Supreme Court is presently hearing a corruption case known as the mensalão (Penal Case 470) in which 36 defendants are charged with running a vote-buying ring.

The sessions in the STF for the mensalão follow a rigid sequence. First, a justice ("redator") appointed by the court presents an oral summary of the case; then another justice ("revisor") reviews the summary.

After that the prosecution presents its case. With so many defendants, so many criminal charges (hundreds of counts, seven different crimes), the country's chief federal prosecutor took five hours to present his case.

Then, the defense lawyers begin making their cases (each defendant's defense lawyer's arguments are limited to an hour).

The defense phase began on Monday, August 6, and, running about five hours a day, will end around August 15.

All this is done orally. Most being read from prepared notes.

Adman Marcos Valério, who is accused of being the main operator of the mensalão scheme that funneled money to members of Congress in return for their votes in favor of the government, was presented by his lawyer, Marcelo Leonardo, as someone who did operate with money that was off-the-books ("não contabilizado").

However, Leonardo claimed his client's money was raised legally. Valério's lawyer admitted his client did give money to members of Congress, but not to buy votes; the money was to pay off campaign debts.

Valério's lawyer then went on to refute all the charges made by the prosecution: conspiracy, malfeasance, money laundering, active and/or passive corruption and illegal remittance of funds out of the country.

The defense strategy, in the case of Valério, and the other defendants, is to admit that the PT committed an electoral crime (used off-the-books funds to pay campaign debts), because it is a lesser crime (compared to vote-buying) and the statute of limitations on electoral crimes committed during the first Lula administration has long passed.

Oh yeah, there are plenty of interesting news for the readers in the U.S.

Many Federal employees are on strike demanding increase in their salaries. The noble professors are still doing "cú doce" and refusing to come back to the class rooms, in spite of government's pleas (Not that Prez Dilma is too concerned about their "plight" and in this aspect I fully back her position). The weather is getting slightly warmer in Southern Brasil and this is a record year for sighting the whale. The harvest of Pinhão has been very good so far.

What else? The babies that were "sold" to the estrangeiros in the 80's and are living overseas now want to meet their "biological" parents.

Oh, ah forgot to add: The rumor goes that ASP is still on the lookout for a competent mason to fix the roof of his leaky cabana.smilies/smiley.gifsmilies/wink.gifsmilies/cheesy.gif

Maybe that should read competent female mason. Asp has made clear his 30 meters of local beachfront terratory upon which the defective cabana is presumed to be situated on or near to is to be maintained, to the extent practical, a testosterone free zone. (If he'll pass on the GPS coordinates I'll see what I can do to get the cruise ship captain to park it offshore for a bit and send me in on a launch with whatever I can round up for "specially equiped" volunteer "helpers" to give the poor guy a leg up on his situation.)

I think you worry too much about the fine points Joao. For sure, as the masterful, detail oriented and foresighted person I am, the cappy will not be allowed to park too close to shore. He won't even be coming ashore and the launch crew staff I will insist he select will also be "specially equipped" as well to ensure we keep down that testosterone level contamination on asp's "sensitive" ambiental. (Did I ever mention I was a very serious environmentalist?) The missuses will just have to wait for the second boat going ashore, about three hours or three and half hours delay I would think would be sufficient for the initial crackerjack group to do their "preparatory" dirty work. After I call in by radio to have them come on ashore they will be swiftly sent into town to do the shopping for preparation for the evening's meal. That should afford another two and a half hours to get things accomplished. And I'm not so worried about asp's duress in furnishing the GPS coordinates, it pales in comparison to the duress I will have to suffer doing the up close and personal inspections to ensure that there are no "Made in China" tags on any beach work attire. Forbid that I error and somehow underestimate the task at hand such that I have to send all but a few back to the ship on one of the launchs while I and asp toil on through the night. The missuses will be okay either way, spending the night in the casino back on board.

Upon further contemplation, I do believe I have met people of both types, those with personality and those one could say had personilality.

When seeing someone holding up a sign that reads "THE END IS NEAR!" and one that holds up a sign that reads "THE END OF THE WORLD IS NEAR!", I wonder what Double-Dot's thoughts and comments might be. Maybe it's not truly a conceptual difference between them, maybe it's just that the former was so poor they couldn't afford to tear off a bigger piece of cardboard from their homestead to write things out on or perhaps that they ran out of stolen magic markers. That or perhaps that the latter was just being too damn verbose.

asp, you should have taken me up on my offers of last year. No doubt I could have arranged to leave behind an "attendant" for your subsequently repaired leaky cabana, one that your missus would not have taken offense to, and you would not have had to now be suffering the consequences and indignity of baixa temporada. Besides, getting that collection of old dirty beach balls of yours clean is a maintenance task that shouldn't be deferred forever. And no, you don't have a chance in hell running against me in the up coming municipal elections for the janitor position that Joao suggests you run for. Treat it as a no compete situation. Fact is I've already got that job sewed up tight and have the illegal aliens already lined up to do the toilet scrubbing part of the task. At US$10 an hour, 5 hours per day, 5 days per week, and at least 30 minutes of that spent doing nothing but watering the flowers and plantings out in front of the building, it beats the pants off of um salaria minimo!

Naw asp, a strafing run would be overkill. As discussed with forrest a long time ago, when it comes to taking out the trash I prefer to do that with style and finesse. The sucker doesn't even know he's got an imaginary quarter sized tatoo in the middle of his forehead and you've got neighbors with clear view rooftops about a 1000 yards out. No collateral damage risk and we'll work on maintaining the ambiental as well. Need a good high tide coming in since we don't have the brownish rust colored sands of Bahia to help mask the minimal spillage. Also have to watch the timing and weather conditions since we wouldn't want to upset any of those mature looking 12 and 13 year olds you've recently been blessed with seeing out prancing by.

The real asp responded in his own defense (with the no green apples repost) in the way I most thoroughly expected and anticipated (except I think he meant to say "they aren't even 14 or 15" with regards to what he's recently had for viewing pleasure on his beach and thus implying they were older instead of saying "they aren't 14 or 15", even if that's when the majority, when plotted agaist a Bell curve, have thier apples begin to bud). I saw a recent documentary that I'm not entirely willing to believe. It tried to show that there are places in India that if a girl is not engaged, promised to be married (by her families arranging for such) or actually married at the age of 12, then her destiny is that of becoming a prostitute and thence working the rest of her life in that fashion supporting all of her parents family, thereafter never having the potential of ever being married. Years ago while walking with a then significant other who has been known to "work" we encountered a 12 and half year old sabrina of her's out patrolling the area. At the 5 foot 9 to 5 foot 11 height I estimated for this kid, her physiologically attractive shape and muscular conditioning, engaging smile, attitude, the way she carried herself, her ability to engage in complex conversation and provide surprisingly inteligent responses in so many areas of local, state and worldly matters, there's no way anyone could have believed she was the age that she was. DotaDota, I'm assuming you are refering to the continueing saga about the "Lord Jim" that's posted under a different title than this "corruption doesn't exist in Brasil" title. Pretty sure Angra dos Reis is where the rotted old sea scow has been marooned. There are alligators in the area for sure. Praia Grande de Palmas on Ilha Grande does have a backwater drainage on it's west end that reportedly has them although we didn't risk going all turtle man and swim back in under the brush to find them ourselves all up close and personal like. As far a killer sharks goes, nope, don't think I've encountered anyone that would confirm they exist in that area although there is a sweet young thing living on the east end of that beach with her mom and grandmom that would certainly snap at ya.

As to you being a "Mormon" (as in "give me more man") type vs a "Cataholic" type, I think the tea and crumpets crowd will likely find that you are fully acceptable under under certain circumstances and scenarios (i.e. as long as you're buying).

I would suggest that quite possibly heading out from Marcos Island affords a better opportunity for picking up some snapper and quickly. I'm sad to say I've never tried my luck in South Beach. As far as where I've encountered ones that bite really really hard, now that I know!
